The US Department of Commerce (DOC) has just issued a preliminary conclusion on the anti-dumping investigation into fiber-cast products imported from Vietnam - Illustrative photo
The investigated product is Molded fiber products, HS code of the product: 4823.70.0020 and 4823.70.0040; some other codes: 4823.61.20, 4823.61.40, 4823.69.20, 4823.69.40.
The plaintiffs are Genera, Tellus Products, LLC, and the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, AFL-CIO ("USW"). The antidumping investigation period is from April 1 to September 30, 2024.
According to the DOC's Preliminary Conclusion, the preliminary antidumping duty rate (after adjusting for countervailing duty) is as follows: The respondent company is required to pay an antidumping duty of 0.76%. The company is entitled to a separate antidumping duty rate of 0.76% (calculated based on the respondent company's required duty rate).
Other companies (companies that did not respond to the QQ and did not apply for separate duty rates): The nationwide anti-dumping duty rate calculated based on available adverse information is 211.60%. Meanwhile, the preliminary anti-dumping duty rates for Chinese companies (also under investigation for this product) range from 47.44% to 477.97%.
According to the Trade Defense Department, this can be considered a positive result for Vietnamese enterprises when exporting the above products to the US market (the cooperating enterprise is also subject to a low preliminary anti-subsidy tax rate of 3.39%). However, caution is still needed because the DOC may adjust the tax rate at the final conclusion of the case.
According to the investigation process, after the preliminary conclusion, DOC will conduct an on-site inspection of Vietnamese enterprises to verify the information provided. In addition, DOC also allows parties to submit comments on the product scope (case brief) within 30 days after the date of issuance of the preliminary conclusion on the product scope (the date of issuance of the preliminary conclusion on the product scope is May 6, 2025) and rebuttal brief within 7 days after the deadline for submitting comments on the product scope. DOC is expected to issue the final conclusion on anti-dumping on July 21, 2025 (subject to extension).
In order to achieve positive results in the final conclusion, the Trade Remedies Authority recommends that relevant enterprises closely monitor the developments of the case and continue to fully cooperate with the DOC because the tax rate may still change in the final conclusion.
