Hoi An: Enforcement of judgment on house and land at 93 Phan Chau Trinh

(QNO) - On the morning of May 23, the Civil Judgment Enforcement Department of Quang Nam province coordinated to enforce the judgment against Mr. Vo Xuan Quang (address 93 Phan Chau Trinh, Hoi An City) according to the judgment of the trial of the inheritance dispute case.

At the enforcement session, the authorities announced the decision to enforce the judgment and forced Mr. Vo Xuan Quang to transfer the right to use the area of 243m2 of land and the house attached to the land at plot number 49, map sheet number 5 (number 93 Phan Chau Trinh) to the buyer who won the auction of the property.

According to the verdict of the High People's Court in Da Nang , Mr. Quang received the inheritance of the house and land attached to it at 93 Phan Chau Trinh (Minh An Ward, Hoi An City) and is responsible for returning the difference to the co-heirs.

According to the content of the enforcement plan of the Civil Judgment Enforcement Department of Quang Nam province, in all working minutes, Mr. Quang stated that the seizure and auction by the civil judgment enforcement agency was in accordance with the law.

According to the Civil Judgment Enforcement Department of Quang Nam province, Mr. Quang has all the rights of the heirs but did not fulfill the obligations to pay money to the co-heirs.

Meanwhile, since the judgment took effect until now (2020), Mr. Quang has continued to exploit, lease, and do business with this property, leading to the infringement of the legitimate rights and interests of the co-heirs.

Therefore, applying coercive measures to force the handover of assets to the auction winner is to ensure the provisions of law as a basis for payment of inheritance division money to co-heirs.

Also according to the content of the plan for compulsory execution of the judgment, Mr. Quang is the person who must execute the judgment but is also the person who receives the inheritance shares according to the judgment.

In addition, according to the verification results of the authorities, Mr. Quang currently has a house and land use rights in Duy Phuoc commune (Duy Xuyen district), so when the enforcement measures are applied, Mr. Quang still has a stable place to live and a source of income for future living expenses.
