Assets located in the new administrative unit, how to receive?
Accordingly, the new commune-level administrative unit (CAU) formed after the arrangement is responsible for receiving and inheriting the management and use of infrastructure assets currently managed and used by the old commune-level administrative unit.
In case the old commune-level administrative unit is divided into many parts to form new commune-level administrative units, the new commune-level administrative unit is responsible for receiving and inheriting the management and use of infrastructure assets of the old commune-level administrative unit located in the area according to the new commune-level administrative unit.
In case the property is located in many new commune-level administrative units, the Chairman of the Provincial People's Committee shall decide on assigning the responsibility of receiving, inheriting the management and use to the provincial agency or the (new) commune-level administrative unit.
For infrastructure assets currently managed by the district level, specifically irrigation and market infrastructure assets: The commune-level administrative unit (new) is responsible for receiving and inheriting the management and use of assets located within the administrative boundaries of the commune-level administrative unit (new).
In case the property is located in many new commune-level administrative units, the Chairman of the Provincial People's Committee shall decide on assigning the responsibility of receiving, inheriting the management and use to the provincial agency or the (new) commune-level administrative unit.
For other types of infrastructure assets, based on the list of assets managed/temporarily managed by the District People's Committee, agencies, organizations and units under its management, the District People's Committee is responsible for synthesizing and reporting to the specialized agency managing the sector or field under the Provincial People's Committee to synthesize and report to the Chairman of the Provincial People's Committee to decide on assigning the responsibility of receiving and inheriting the management and use to the provincial agency or the (new) commune-level administrative unit.
For infrastructure assets currently managed by the provincial level: The (new) provincial administrative unit is responsible for receiving and inheriting the management and use of assets currently managed and used by the (old) provincial administrative unit.
Plan for handover, management and handling of assets with established public ownership
In this regulation, the Ministry of Finance also clearly states that for assets managed by the asset management unit, which is an agency, organization, or unit under the commune level, and has not completed the handling by the time of the arrangement of the commune-level administrative unit: The commune-level administrative unit (new) is responsible for receiving, implementing the management, and handling of assets managed by the commune-level administrative unit (old).
In case the old commune-level administrative unit is divided into many parts to form new commune-level administrative units, the Provincial People's Committee shall specifically determine the new commune-level administrative unit responsible for receiving, managing and handling assets.
For assets managed by the asset management unit which is an agency, organization or unit under the district level and has not completed the handling by the time of abandoning the district-level administrative unit: The Chairman of the Provincial People's Committee shall assign the specialized agency under the Provincial People's Committee or the (new) commune-level administrative unit to receive and carry out the management and handling of the assets according to regulations.
For assets managed by the asset management unit which is an agency, organization or unit under the provincial level, and has not completed the handling by the time of the arrangement of the provincial administrative unit: The (new) provincial administrative unit is responsible for receiving and inheriting the management and handling of assets managed by the (old) provincial administrative unit.
For assets currently managed by central agencies that are no longer managed by such agencies due to restructuring of the apparatus to suit the arrangement of administrative units: The Minister or head of a central agency shall decide to assign the agency or unit under the ministry or central agency to be responsible for receiving, managing, and handling assets in accordance with the provisions of law.
How to hand over, manage and handle projects using state capital?
The official dispatch of the Ministry of Finance clearly stipulates that assets serving project activities are implemented according to the instructions in previous official dispatches of the Ministry of Finance.
For assets that are the result of completed projects: Ministers, heads of central agencies, and provincial People's Committees shall direct project management boards and project investors (in cases where there is no project management board or the project management board has been dissolved) to conduct a review to: Complete the handover of assets to beneficiaries in accordance with the provisions of law (for projects that have specifically identified beneficiaries).
In particular, note to fully hand over information about the value of the asset to serve the management and accounting of the beneficiary after handover.
Report to the competent authority or person to consider and decide on the handling of assets in accordance with the provisions of law (for projects that have not yet identified specific beneficiaries); in case the handling has not been completed by the time of arranging the administrative unit, it shall be implemented according to the principles set forth in this Official Dispatch.
For unfinished projects, follow the guidance of the Ministry of Finance in Official Dispatch No. 4738/BTC-TH dated April 14, 2025 on transitioning public investment management when arranging and perfecting the organization of the 2-level local government apparatus.
Guarantee of no interruption of service provision
To facilitate the handover, management and handling of assets, the Ministry of Finance has issued a general principle: Agencies, organizations and units subject to the arrangement of public administrative units shall conduct an inventory and make a list of public assets, which are infrastructure assets, assets with established public ownership, and assets of projects using state capital managed/temporarily managed by the agencies, organizations and units they are managing.
On that basis, based on the Project on arrangement and reorganization of administrative units at all levels approved by competent agencies and individuals, the handover of assets to agencies, organizations and units assigned the responsibility of receiving and managing assets shall be carried out in accordance with the provisions of law and the guidance in this Official Dispatch.
The handover and acceptance are made into a record including the following main contents: Participants in the handover and acceptance; List of assets handed over and accepted; Documents related to the assets; Responsibilities of the relevant parties.
In particular, the Ministry of Finance noted that the agencies, organizations and units assigned with the responsibility of receiving assets are responsible for receiving assets, managing and handling assets in accordance with the provisions of law; ensuring that there is no interruption in service provision, serving national interests, public interests, and not causing loss or waste of assets.
