
In his opening remarks, Minister of Justice Hoang Thanh Tung affirmed that the Law on the Promulgation of Legal Normative Documents has, in recent years, created an important legal foundation for the improvement of the legal system. However, in light of the demands for institutional reform and enhanced national governance effectiveness, many new policies of the Party require continued strong innovation in the activities of lawmaking and enforcement.
According to the Minister, Resolution No. 66-NQ/TW of the Politburo on reforming the work of drafting and implementing laws, along with Conclusion No. 09-KL/TW on perfecting the structure of the Vietnamese legal system, has clearly defined the orientation for building a hierarchical legal system, while expanding the scope of application of supplementary sources such as case law, customs, and legal principles. One of the notable requirements is prioritizing the application of specialized legal norms in cases where there are differing provisions on the same issue.
Based on that, the Politburo assigned the Party Committee of the Government to direct research on amending and supplementing the Law on the Promulgation of Legal Normative Documents, to be submitted to the National Assembly for consideration at the 2nd Session in 2026, and expected to take effect from March 1, 2027. According to Minister Hoang Thanh Tung, the drafting of a new law to replace the current law is an objective and urgent requirement to meet the demands of reforming the legislative process in the new development stage.
Reporting at the conference, Nguyen Quoc Hoan, Director of the Department of Legal Document Drafting, stated that the quality of legal documents has continued to improve; many documents have been issued promptly to institutionalize the Party's policies, promote decentralization and delegation of power, digital transformation, and the development of science and technology.

However, the process of implementing the Law still reveals many limitations. The current system of legal documents is cumbersome, multi-layered, overlapping, and inconsistent, causing difficulties in practical application. Some regulations are unclear regarding the authority to issue, legal effect, policy-making process, and mechanisms for handling urgent situations. The quality of policy-making in some agencies is still limited; policy impact assessments are sometimes merely формаl, while delays in providing feedback and incomplete explanations still occur.
Based on this experience, the Ministry of Justice proposes continuing to review and simplify the system of legal normative documents, streamlining the forms of documents and the competent authorities for issuance; clearly defining the hierarchy of legal effect to overcome overlapping and conflicting situations; and researching the expansion of the applicability of supplementary sources such as case law, equity principles, and legal doctrines in the process of applying the law.

Delegates attending the conference focused on discussing various solutions to improve the quality of lawmaking and implementation, aiming to build a more comprehensive, transparent, and feasible legal system in the new development phase of the country.
