The Investigation Police Department of Hanoi City Police has issued a decision to initiate criminal proceedings against Ms. Phung Thi Hien, Director of Tom Tourism Trading and Tourism Company Limited, after receiving numerous complaints alleging that Ms. Hien committed fraud and misappropriation of property with the promise of processing procedures to send people to Australia and Canada.

The Investigation Police Department of Hanoi City Police has just issued a notice regarding the results of handling criminal complaints to several citizens residing in Hanoi. According to the notice, the Investigation Police Department received a complaint alleging that Mr. Doan Quang Linh, while traveling to Taiwan (China) and Thailand through a company owned by Phung Thi Hien, the director and representative of Tom Tourism Trading and Tourism Co., Ltd. (headquartered in Quan Hoa Ward, Cau Giay District, Hanoi), allegedly committed fraud and misappropriated 345 million VND from Mr. Linh by receiving money to process documents for his exit to Canada. In addition, several other citizens also filed complaints alleging Phung Thi Hien defrauded them of a total of over 700 million VND by receiving money to process documents for citizens to exit to Australia.

Following an investigation into the complaint, the Criminal Investigation Agency of the Hanoi City Police Department has decided to initiate a criminal case. The reason is that Phung Thi Hien, Director of Tom Tourism Company (a travel agency not authorized to handle paperwork and procedures for Vietnamese citizens to travel abroad), promised and assured Mr. Doan Quang Linh that she could obtain the necessary documents for him to travel to Canada.

On December 25, 2023, Hien received a deposit of 12 million VND. On January 4, 2024, Hien received another 150 million VND from Mr. Linh. Hien claimed that all of Mr. Linh's documents had been given to Nguyen Tat Duc (who works in the tourism industry) to process, but Duc denied knowing anything about the documents related to Mr. Linh. Duc also claimed he had never met Mr. Linh. Subsequently, Mr. Linh was unable to leave the country because Hien's company repeatedly delayed the process for various reasons, but Hien still insisted that Mr. Linh had been granted permission to travel to Canada and refused to return the money.

The investigating agency verified with the Immigration Department (A08), Ministry of Public Security , that Mr. Linh has not left the country since January 4, 2024. Phung Thi Hien's actions show signs of committing the crime of fraud and appropriation of property as stipulated in Clause 2, Article 174 of the Penal Code.

Previously, on November 25th and December 25th, 2024, Dai Doan Ket Newspaper published articles reflecting on the case of many citizens filing complaints with relevant authorities regarding alleged violations of the law by Ms. Phung Thi Hien, Director of Tom Tourism Company. For example, Mr. Nguyen Viet Kham (residing in Do Dong commune, Thanh Oai district, Hanoi) stated that around the beginning of 2024, through an acquaintance, he learned about Ms. Phung Thi Hien, Director of Tom Tourism Company. During their interactions, Mr. Kham expressed his desire to work in Australia and received a promise of assistance. Ms. Hien promised to handle all necessary paperwork, visas, and passports to ensure Mr. Kham's entry into Australia as a tourist. Mr. Kham was required to pay Ms. Hien's company 284 million VND.

According to Mr. Kham's account, after receiving the deposit, Ms. Hien repeatedly announced changes to the flight schedule for his departure to Australia. The initial itinerary was to fly to Hong Kong (China) and then travel to Australia. However, Ms. Hien and the company did not adhere to the agreement, instead taking Mr. Kham to Thailand and then back to Ho Chi Minh City. Afterward, they continued to transport him across the Cambodian border by land to Hong Kong (China). To build trust with Mr. Kham, before his departure to Australia, Ms. Hien signed a commitment guaranteeing the flight schedule and entry into Australia before September 30, 2024. If the schedule was not followed, the company would refund 100% of the money received from Mr. Kham. However, Ms. Hien repeatedly promised the flight times and schedules but continuously changed the flight schedule despite her commitments. To date, Mr. Kham has not been able to fly to Australia, and Ms. Hien has not refunded the money received from him.

In a related development, following complaints from citizens, the Department of Overseas Labor Management verified and determined that Tom Tourism Company does not have a license to operate services for sending Vietnamese workers abroad under contract. The Department of Overseas Labor Management forwarded the citizens' complaints and requested the police to investigate, verify, and handle the case according to the law.
