Many leaders of Bac Ninh Department of Construction were named
According to the Inspection Conclusion, in the existing problems and limitations related to the Kim Do Policity project invested by Hung Ngan Housing and Trade Investment Joint Stock Company (Hung Ngan Group), many units under the People's Committee of Bac Ninh province are partly responsible, including the Department of Construction, Department of Transport, Yen Phong District People's Committee and the Compensation, Support and Site Clearance Council of Yen Phong district.
At the same time, the Inspectorate also recommended administrative action against individuals and groups belonging to the above units, including:
Mr. Cao Van Ha - former Director of the Department of Construction, signed Decision No. 340/QD-SXD dated November 20, 2015 approving the 1/500 detailed planning of the urban service area in the West of Cho town. This planning is not unified and synchronous in recording the number of adjacent floors and villas.

Mr. Nguyen Tien Tai - Secretary of Tien Du District Party Committee, when in his position as Director of the Department of Construction, signed documents 199/SXD-DT&HT appraising the BVTC on July 14, 2020 and 2308/SXD-QH dated November 2, 2020. The appraisal of construction drawings and estimates for the technical infrastructure part did not point out any violations by the contractor designing the BVTC for the technical infrastructure part that did not comply with the standards. At the same time, the violation was also in the approval of the model of adjacent houses and villas, recording the height as the number of floors in the documents approving the urban design models of the Project, which was not in accordance with Clause 9, Article 90, Construction Law No. 50/2014/QH13 dated June 18, 2014.
Mr. Nguyen Van Hoan - Deputy Director of the Department of Construction signed document 126/SXD-DT&HT on December 7, 2021 to appraise the BVTC. The appraisal of the construction drawings and estimates for the technical and technical part has not pointed out any violations by the BVTC design contractor in the technical and technical part of the design that did not comply with the standards.
Mr. Nguyen Tuan Dung - Deputy Director of the Department of Construction signed document 695/SXD-QH dated April 28, 2023, approving the model of townhouses and villas, recording the height as the number of floors in the documents approving the urban design models of the project, which is not in accordance with Clause 9, Article 90, Construction Law No. 50/2014/QH13 dated June 18, 2014.
In addition, the collective leadership of the Department of Construction was also recommended to be disciplined for not fully implementing the direction of the Chairman of the Provincial People's Committee in Official Dispatch No. 1489/UBND-XDCB dated May 23, 2023 on the Construction Investment Project to renovate and upgrade TL.286, from Cho town to Do Lo bridge, Yen Phong district under the BT form. The direction of the Chairman of the Bac Ninh Provincial People's Committee is as follows: "... For the remaining land plots, the Department of Construction shall preside over and coordinate with departments, branches and the People's Committee of Yen Phong district to review the planning, complete procedures and documents; advise the Provincial People's Committee to conduct bidding to select investors to build urban areas according to current regulations ".
The Department of Transport and the People's Committee of Yen Phong district have not yet fully implemented the direction of the Provincial Chairman.
Similarly, the leaders of the Department of Transport were also recommended to be disciplined for not fully implementing the direction of the Chairman of the Provincial People's Committee in Official Dispatch No. 1489/UBND-XDCB dated May 23, 2023 on the Project of Construction Investment to renovate and upgrade TL.286, section from Cho town to Do Lo bridge, Yen Phong district under the BT form, in the settlement of interest on capital mobilization loans of Hung Ngan Group.
Regarding the leaders of Yen Phong district, the Inspection Conclusion also recommended handling the responsibility of Mr. Nguyen Duy Phuc - Vice Chairman of the People's Committee and People's Council of Yen Phong district for signing Decision No. 5317/QD-UBND dated June 14, 2018 on approving the compensation and support plan when the State reclaims land to implement the Project of building an urban and service area west of Cho town, Yen Phong district. His violation was approving the support budget for the assets on the land, without consulting the Chairman of the Provincial People's Committee as prescribed.
At the same time, in his position as Chairman of the Compensation and Site Clearance Council of Yen Phong district, Mr. Nguyen Duy Phuc was also recommended to be fined for violating the payment of compensation and support costs adjusted and supplemented before the People's Committee of Yen Phong district issued a Decision approving the compensation and support plan adjusted and supplemented when the State reclaimed land to implement the Project (phase 1); The minutes of land and property inventory on land serving the compensation and site clearance to implement the Project (phase 1 adjustment and supplement) did not specify a specific date.

Regarding the People's Committee of Yen Phong district, the inspection team recommended handling responsibilities for 2 violations including: Not approving the compensation plan for 8,662.6m2 of difficult-to-cultivate agricultural land that was recovered by the People's Committee of Yen Phong district from 31 households and the People's Committee of Yen Phu commune (agricultural land area managed by the People's Committee of the commune) in the Land Recovery Decisions dated June 14, 2018; Not fully implementing the direction of the Chairman of the People's Committee of Bac Ninh province in Official Dispatch No. 1489/UBND-XDCB dated May 23, 2023 on the Construction Investment Project to renovate and upgrade TL.286, the section from Cho town to Do Lo bridge, Yen Phong district under the BT form.
Kim Do Policity is a project to repay counterpart funds for the Investment Project to build, renovate and upgrade TL286 from Cho town to Do Lo bridge, Yen Phong district under the BT form. This project was approved by the People's Committee of Bac Ninh province in the Investment Policy Decision No. 95/QD-UBND dated February 9, 2018, with an area of 75 hectares, a total investment of more than 3,569 billion VND, and a construction progress until 2025.
At the time of inspection, Hung Ngan Group had constructed 92/509 townhouses; 30 villas had not yet been built. The company had been granted 192 Land Use Rights Certificates by the Department of Natural Resources and Environment of Bac Ninh province, corresponding to 513/539 lots. At the time of inspection, Hung Ngan Group had signed contracts to buy and sell 152/539 future houses to customers and had handed over 6 townhouses with completed rough construction to customers.
The Inspectorate discovered that this company has not signed a Guarantee Contract with a commercial bank that has sufficient capacity to guarantee the financial obligations of the Investor to customers in the sale, lease, and purchase of future housing. This act violated Article 56 of the 2014 Law on Real Estate Business, which stipulates guarantees in the sale and lease-purchase of future housing.
The Inspectorate also recommended handling the responsibility of Hung Ngan Group due to the shortcomings and limitations related to investment, construction, land, finance, and real estate business during the project implementation process.
