Accordingly, the Chairman of the People's Committee of Lam Dong province announced: The entire area of land previously allocated, leased, and permitted to Saigon Dai Ninh Investment - Tourism Joint Stock Company (Saigon Dai Ninh Company) for land use conversion to implement the Dai Ninh Commercial, Tourism, and Ecological Resort Urban Area project (Dai Ninh project) will be revoked.
Specifically, the area of land to be reclaimed according to legal documents is 1,428.356 hectares; the actual area is 1,434.763 hectares (an increase of 6.404 hectares due to recalculation of the area) located in the communes of Phu Hoi, Ninh Gia, Ta Hine, and Ninh Loan (formerly Duc Trong district), now the communes of Duc Trong, Ninh Gia, and Ta Hine.
According to the Provincial People's Committee, the reason for land reclamation is that Saigon Dai Ninh Company violated land laws as stipulated in point i, clause 1, Article 64 of the 2013 Land Law (now clause 8, Article 81 of the 2024 Land Law) and was granted an extension of 24 months by the Lam Dong Provincial People's Committee (formerly) in Official Letter No. 725/UBND-DC dated January 28, 2022, but has still not put the land into use.
Within 45 days from the date of receiving the notice, Saigon Dai Ninh Company, the owner of the assets attached to the land, and those with related rights and obligations are responsible for independently organizing the handling of assets on the land (if any); in case contact cannot be made with the landowner whose land is being expropriated or the landowner whose land is being expropriated does not receive this notice, the 45-day period will be calculated from the date of postal delivery.
Within the prescribed timeframe, the Provincial People's Committee shall instruct the Department of Agriculture and Environment to promptly submit to the Chairman of the Provincial People's Committee for signing and issuance the Decision on land reclamation in accordance with current laws and regulations and ensuring it is consistent with the actual situation in the locality.
The Saigon Dai Ninh project was granted an investment certificate by the Lam Dong Provincial People's Committee in 2010. The total project area is 3,595 hectares with a total investment of over 25,000 billion VND.
According to the plan, the project was to be implemented from 2010 to 2018. However, to date, only over 20 km of internal roads and some other items have been constructed, and numerous violations have occurred, resulting in deforestation and encroachment on project land...
