Reader's Perspective: Awaiting New Land Policies

Readers of Thanh Nien Newspaper are paying close attention to the ongoing 4th session of the 15th National Assembly, especially the amendment of the Land Law at this session.

As Thanh Nien newspaper reported, in his opening remarks at the 4th session of the 15th National Assembly , National Assembly Chairman Vuong Dinh Hue emphasized very high requirements for amending the Land Law at the session.

The Chairman of the National Assembly proposed clearly separating and incorporating into the law land relations of a public nature and land relations of a private nature, ensuring that land belongs to the entire people, with the state acting as the representative owner and managing it uniformly; and ensuring compatibility and consistency with the socialist-oriented market economy .

"We must not legitimize obstacles that constitute violations; we must not include in the law issues that are incidental, minor, or individual, and do not accurately reflect the nature of land relations arising in practice," the Chairman of the National Assembly emphasized.

Balancing interests

Commenting on the "high demands" placed on the desks of National Assembly delegates, reader Huong Giang stated: "I strongly agree with the statement of the Chairman of the National Assembly; the Land Law needs to be revised to be more detailed and meticulous to avoid misunderstandings that lead to widespread land expropriation, pursuit of group interests, loss of national assets, and harm to the people due to inadequate compensation, causing resentment and delays in projects."

The discussion on clearly separating public and private land relations is hoped to resolve land conflicts arising from practice, especially by harmonizing the interests of the community and individuals, and between the state and the people. Mr. Hung analyzed: “It is necessary to pay closer attention to the points emphasized by the Chairman of the National Assembly, to see that major shortcomings in land management have been identified. If timely amendments and additions are not made to harmonize and ensure the legitimate interests of the people and the public needs of the community… the consequences will continue.”

Concurring, Mr. Phong Nguyen also suggested: "Limit adjustments to land-related planning once a long-term planning scope has been determined. There have been many cases where requests for large land areas for good purposes have been made, only to be suddenly adjusted, subdivided, and have increased building density after approval, ultimately resulting in densely packed residential areas that are suffocating, putting pressure on transportation infrastructure, drainage, and environmental sanitation."

Long-term legal framework

To limit inconsistent interpretations or applications, many commenters agreed with commenter Phuong06's opinion: "Once enacted, a law must have practical and long-lasting value; it must be a legal framework, a solid foundation so that everyone can confidently navigate within it and cannot circumvent the regulations." To achieve this, in addition to having a forward-looking vision, commenters also hope that amendments to the Land Law will closely reflect the diverse and constantly evolving realities of life.

Delegate Thang Le argued, "We want civilized cities with synchronized infrastructure, but if land users, including those to whom the state allocates land without collecting land use fees, are allowed to negotiate freely, which businesses would dare to invest?" Delegate Minh Nghia analyzed: "That's why the specialized agencies assisting the National Assembly and the Government are very important. But most importantly, the advisory opinions must be based on reality, accepting objective factors, even market factors, and not be purely ideological or... inconsistent."

I believe it's necessary to focus research to ensure that the Land Law has no loopholes when applied down to the grassroots level of administration, such as wards, communes, districts, and counties. These are the most direct and closest levels of administration, and therefore they often wield considerable power.
