The US has reached a preliminary conclusion regarding the anti-dumping case against Vietnamese shrimp.

DNVN - The preliminary conclusions of the 20th administrative review (POR20) of the anti-dumping duty order on frozen warmwater shrimp from Vietnam exported to the US have just been announced by the US side. In this decision, two mandatory respondent companies were assigned anti-dumping duties of 6.76% and 10.76%, respectively.

The Trade Remedies Department ( Ministry of Industry and Trade ) announced that on May 8, 2026, the US Department of Commerce (DOC) issued its preliminary findings in the 20th administrative review (POR20) of the anti-dumping duty order on frozen warmwater shrimp from Vietnam exported to the US during the period from February 1, 2024 to January 31, 2025.

During this review, 29 Vietnamese companies promptly submitted applications requesting individualized tariff rates and were approved by the DOC. Of these, the DOC selected two companies as mandatory respondents.

According to preliminary findings, the DOC determined the anti-dumping duties for the two mandatory respondent companies to be 6.76% and 10.76%, respectively. One of the two companies was found to have failed to provide complete descriptions of certain input chemicals for the DOC to compare with corresponding substitute values. Therefore, the DOC applied unfavorable available data to a portion of the input costs.

The remaining 27 businesses are subject to an individual tax rate of 7.56%, corresponding to the weighted average tax rate of the two mandatory respondent businesses.

Additionally, the DOC plans to cancel the review for eight companies due to the absence of export shipments subject to consideration during the review period. Meanwhile, 132 companies that failed to demonstrate eligibility for the individual tariff rate will continue to be subject to the nationwide tariff rate of 25.76%.

According to regulations, interested parties may submit comments to the DOC within 21 days of the date of publication in the Federal Register. Rebuttals, limited to the content of the comments already submitted, must be submitted within 5 days thereafter. Parties may also request a hearing within 30 days of the date this notice is published in the Federal Register.

The DOC expects to issue its final conclusions on this review around November 2026, which is within 120 days of the publication of the preliminary findings.

To respond effectively and achieve the best results, the Trade Remedies Department recommends that the Vietnam Association of Seafood Processing and Export (VASEP) and related businesses fully and comprehensively cooperate with the DOC throughout the review process to avoid being considered uncooperative and being subjected to unfavorable tariffs.

The Bureau also requested that businesses promptly submit necessary comments and counter-arguments so that the DOC can adjust the tariff rates in the final conclusion in a more positive direction; and to discuss and propose support measures to the Government if necessary.
