On the evening of May 20, the Dong Nai Province Department of Health said it had just sent a document reporting the progress of handling information about Nestlé Milo milk advertising to the Food Safety Department ( Ministry of Health ).
Previously, implementing the official dispatch of the Food Safety Department on coordinating information handling, the Dong Nai Provincial Department of Health invited relevant parties to meet to agree on handling information about product advertising.
On May 15, the Dong Nai Provincial Department of Health directed the Food Safety and Hygiene Department and the Department Inspectorate to coordinate with the Inspectorate and the Press and Publishing Management Department (Dong Nai Provincial Department of Culture, Sports and Tourism) to work with representatives of Nestlé Vietnam Co., Ltd. (An Binh Ward, Bien Hoa City).
At the time of the meeting, the company presented two products "Nestlé Milo 3-in-1 barley drink supplement" (product self-declaration dated December 27, 2021), and "Nestlé Milo barley drink supplement" (product self-declaration dated August 10, 2022) according to the official dispatch of the Department of Food Safety, which is not related to the use of information from the Institute of Nutrition on the product label.
Nestlé Vietnam confirms that it only uses information from the Institute of Nutrition on the product label "Nestlé Milo barley milk supplement", other products of the company do not use information from the Institute of Nutrition.
In addition, the company provided a confirmation document from the Institute of Nutrition (January 25, 2024) regarding research evaluating the effectiveness of the product combined with physical education for primary school students, agreeing with the content: the product helps improve physical qualities after 3 months of use.
While waiting for instructions, Nestlé Vietnam has proactively stopped all advertisements related to the Institute of Nutrition on television, digital platforms, social networks, billboards...
At the same time, the company asked partners to stop posting related content and planned to change the packaging, expected to launch in September 2025.
Also at this working session, according to the representative of the Department of Culture, Sports and Tourism of Dong Nai province, through review since the beginning of 2025, an advertisement dossier on a banner for the product "Nestle's Milo barley milk", with the content "Milo with A2 cool milk, buy now for your baby" by CPM Vietnam Joint Stock Company (HCMC) has been received.
In January 2025, the Inspectorate of the Department of Culture, Sports and Tourism inspected and handled a large wall-mounted billboard with the content "Milo is more durable" with the phrase "clinically tested by the Institute of Nutrition" for not notifying the authorities about the advertising content.
The authorities have asked Nestlé Vietnam to review the implementation of advertising product notifications in accordance with the law. In particular, it noted the signing of contracts with partner companies that carry out advertising.
In addition, the company is requested to report in writing the process since self-declaring the product "Nestlé Milo barley milk supplement" before May 22.
Dong Nai Provincial Department of Health is continuing to coordinate with relevant agencies to inspect and verify related contents according to regulations.
Verify advertising information on Nestlé Milo products
On April 22, the Food Safety Department sent a document to the Dong Nai Provincial Department of Health regarding coordination in handling information.
Accordingly, the Food Safety Department received feedback from the press requesting information about the advertisement of Nestlé Milo barley milk product.
Through research, this product was self-declared by Nestlé Vietnam Company Limited as "Nestlé Milo 3-in-1 Barley Drink Supplement" and "Nestlé Milo Barley Drink Supplement" and sent the self-declaration file to the Department of Food Safety and Hygiene of Dong Nai province (now the Department of Food Safety, Department of Health of Dong Nai province) for management.
According to the provisions of Article 40 of Decree 15/2018/ND-CP detailing the implementation of a number of articles of the Law on Food Safety, the Department of Food Safety transfers documents on the advertising of the above product to the Department of Health of Dong Nai province for inspection, verification of information and handling according to current regulations (if any) and notifies the Department of Food Safety of the results of handling the case for synthesis.
