(MPI) - The Government has just issued Decree No. 137/2024/ND-CP dated October 23, 2024 regulating electronic transactions of state agencies and information systems serving electronic transactions.

The Decree clearly states that state agencies prioritize the implementation of all activities in the electronic environment, including: providing public services; internal administration; direction, operation; supervision, inspection, and examination according to a suitable roadmap and plan.
Building a plan for information technology application and digital transformation
Accordingly, the Decree requires the development of a plan for applying information technology and digital transformation to serve the operations of state agencies in the electronic environment: ministries, ministerial-level agencies, government agencies (ministries, branches), People's Committees of provinces and centrally run cities (provincial People's Committees) are responsible for developing, approving and organizing the implementation of 5-year plans and annual plans on applying information technology and digital transformation; which must include goals, tasks and solutions to bring the operations of state agencies towards full implementation in the electronic environment, at least including the following areas of operation: providing public services; internal administration; direction, operation; supervision, inspection.
Information systems and digital platforms serving the operations of state agencies in the electronic environment must ensure compliance with the Vietnam e-Government Architecture Framework and the Ministry and Provincial Government Architecture Framework; ensure the ability to integrate, interconnect, share, use and reuse information and data; ensure authenticity, reliability, integrity and the ability to be easily accessible, accessed, and used continuously and stably.
At the same time, it allows checking and verifying information and data for reporting, business connection and meeting other requirements of competent agencies, organizations and individuals when requested; ensuring the ability to develop, upgrade and expand according to practical needs; ensuring legal requirements on network information security and network security; ensuring other requirements according to relevant legal provisions.
The deployment of information systems and digital platforms to serve the operations of state agencies in the electronic environment must be closely linked to administrative reform of state agencies to innovate working methods, direction and operation based on data, enhance the processing of documents and work records in the electronic environment, improve the performance and efficiency of state agencies; reduce costs and time for processing work.
Receive and resolve requests from organizations and individuals in the electronic environment
State agencies in receiving and handling requests from organizations and individuals in the electronic environment must be responsible for receiving and handling requests from organizations and individuals in the electronic environment, except where otherwise provided by law. In case of refusal to receive or handle, the reasons must be clearly stated so that the organizations and individuals are informed.
Establish communication channels in the electronic environment and issue operating regulations to receive and resolve requests from organizations and individuals, except where otherwise provided by law;
The results of handling requests from organizations and individuals must be notified in the electronic environment through electronic means and communication channels, except in cases where the law provides otherwise or at the request of the organization or individual making the request.
Communication channels of state agencies in the electronic environment include the following channels: Information provision channels and online public service provision channels according to Government regulations on the provision of information and online public services of state agencies in the electronic environment; National Public Service Portal; Other communication channels according to relevant laws.
Providing online public services and administrative procedures in the electronic environment
The Decree also states that administrative procedures and public administrative services that are or are not required to be performed electronically shall be implemented in accordance with the Government's regulations on performing administrative procedures in the electronic environment and the Government's regulations on providing information and online public services of state agencies in the network environment, except in cases where other laws stipulate that they cannot be performed electronically.
Public administrative services are provided online throughout the process based on reviewing and restructuring processes, meeting quality requirements according to Government regulations on performing administrative procedures in the electronic environment, implementing a one-stop, one-stop mechanism in handling administrative procedures and providing information and online public services in the network environment.
State agencies are responsible for handling administrative procedures and providing online public services in full when they are eligible to carry out the entire process from start to finish electronically. In cases where the entire process has not been carried out electronically, state agencies must notify organizations and individuals.
Ministries, ministerial-level agencies, government agencies, and provincial People's Committees shall review, promulgate, and organize the implementation of plans to provide public career services and online public services within their scope of management.
Directing and operating in electronic environment
State agencies are ministries, ministerial-level agencies, and provincial People's Committees in organizing the implementation of direction and administration in the electronic environment and are responsible for: developing and promulgating a set of indicators to serve the direction and administration in the electronic environment according to regulations, ensuring that they are suitable to the needs, resources, and readiness level of the information system and database.
Deploy the Information System serving the direction and administration at the ministerial and provincial levels to ensure the collection, creation, synthesis, analysis, processing, storage, connection, and sharing of information and data with the Information System serving the direction and administration of the Government and the Prime Minister according to the regulations and instructions of the Government Office ; connect and share information and data with the information system serving the direction and administration of other ministries, branches, and provincial People's Committees when requested; be responsible for the completeness, integrity, accuracy, timeliness, and ensuring network information security and network safety of the information and data provided within the authority and meeting the requirements.
Monitoring and checking in electronic environment
Ministries, branches, and provincial People's Committees, according to their authority, are responsible for reviewing and simplifying the monitoring and inspection process; and developing a monitoring and inspection process in the electronic environment.
Guide and implement monitoring and inspection activities in the electronic environment in the fields and areas within the assigned scope of tasks and powers.
Build digital platforms and technical tools to serve monitoring and inspection activities in the electronic environment within the scope of assigned tasks and powers.
Organizations and individuals are responsible for complying with the monitoring and inspection activities in the electronic environment of competent authorities./.
