This morning (June 28), with a very high consensus rate (462/470 delegates present in favor, 95.06% of the total number of delegates), the 15th National Assembly officially passed the Capital Law (amended) project. This is good news not only for the people of the Capital but also for the whole country, because the Capital Law 2024 with many new points is expected to open a "new era" for Hanoi. Below are the notes of the reporter of the Law and Society page, Economic and Urban Newspaper on the opinions of the people, experts, officials... when the Capital Law (amended) was passed.
Many new and progressive points
Associate Professor, Dr. Bui Thi An, Member of the 13th National Assembly, Director of the Institute of Natural Resources, Environment and Community Development, President of the Hanoi Association of Intellectual Women:
The official approval of the Capital Law (amended) is truly great news not only for Hanoians. Closely following the process of building the Law, I see that the Law is built on 5 guiding viewpoints: Fully institutionalizing the Party's policies and guidelines on building and developing the Capital; Stipulating specific mechanisms and policies for the Capital to ensure consistency with the Party's policies and guidelines and compliance with the 2013 Constitution; Closely following the 9 groups of policies approved by the Government ; Detailing and concretizing the maximum number of specific mechanisms and policies in the Law for immediate application; Inheriting and developing the effective regulations of the 2012 Capital Law that have been tested in practice; legalizing specific mechanisms and policies that are being piloted for provinces and centrally-run cities in accordance with the Capital.
The Law consists of 7 Chapters and 54 Articles, while the 2012 Law on the Capital City only has 4 Chapters and 27 Articles. It can be said that this is a particularly important Law project for the development of the Capital City, as well as the overall development of the whole country. If the current Law on the Capital City is mainly a framework, then this revised draft Law has gone into very specific contents related to decentralization and delegation of power.
Notably, the Law has many new contents such as regulations on: Urban government organization, construction, development, management and protection of the Capital; Finance, budget and resource mobilization for the development of the Capital; Regional linkage and development; Supervision, inspection, examination and responsibility for construction, development, management and protection of the Capital... "I think these are breakthrough regulations to promote the development of the Capital".

The Capital Law (amended) was approved by the delegates with a rate of 95.06%, which I believe is a high level of trust, demonstrating the quality of the Capital Law 2024.
This Law has many new points, of which I am very pleased with Article 4 regulating the application of the Capital Law, which is an Article that the 2012 Capital Law does not have. Article 4 states:
1. In case there are different provisions between the Law on the Capital and other laws or resolutions of the National Assembly on the same issue, the provisions of the Law on the Capital shall apply, except for the case specified in Clause 2 of this Article.
2. In case a law or resolution of the National Assembly issued after the effective date of the Law on the Capital has provisions different from those of the Law on the Capital on the same issue that need to be applied, specific provisions must be immediately made on the application of the law in that law or resolution; in case there are no specific provisions on the application of the law and the application of such provisions is necessary for the construction, development, management and protection of the Capital, the Standing Committee of the National Assembly shall decide on the application upon the proposal of the Government and report to the National Assembly at the nearest session.
3. Legal documents detailing the contents of the Law on the Capital, legal documents issued to exercise the authority assigned in the Law on the Capital shall be applied in cases where there are many legal documents with different provisions on the same issue...
I think that the regulations on the application of the Capital Law are very important because they are related to the effectiveness and efficiency of the implementation of this law in practice. With many specific regulations, creating a separate mechanism for Hanoi city, it is extremely necessary to handle the relationship between the Capital Law and other laws and resolutions of the National Assembly, and to apply detailed regulations and implementation instructions of the Government, ministries and branches.
The driving force and attraction for Hanoi to attract talented people

Today, the National Assembly delegates have officially voted to pass the Law on the Capital (amended), I am very excited. We have a common policy for the whole country, but for the Capital, with its special position, the heart of the whole country, the Capital needs a special mechanism. When the Capital develops, the whole country will also develop together.
I am particularly pleased with the new point of the Law stipulated in Article 16 on attracting and employing talented people and developing high-quality human resources.
The decentralization of power to Hanoi with outstanding and specific policies to attract high-quality human resources but still respect them and retain them for the long term with the development of the capital is a point that I highly appreciate in the policy content in this draft Law.
In particular, Point c, Article 16 of the Law states: “Foreigners with high professional qualifications, extensive practical experience, whose works or products have been accepted, recognized, and applied with high efficiency may sign contracts to perform the tasks of construction, development, management, and protection of the Capital”…
Thus, employing talented people, including foreigners with high professional qualifications and practical experience, will help Hanoi develop more and more, becoming the locomotive of the whole country.
Mr. Nguyen Thanh Son, Head of Justice Department of Ba Vi district, Hanoi :
The Capital Law (amended) with many new points, creates a breakthrough mechanism for Hanoi, especially in terms of planning and decentralization. Therefore, the Law passed, we see, opens up a great development opportunity for our Capital.
Regarding the regulations on perfecting the urban government apparatus in Hanoi, I think this is also a new content compared to the 2012 Capital Law. The Capital Law (amended) decentralizes more power to the People's Council and People's Committee of Hanoi to decide on issues related to the organization of the apparatus; has policies related to the management of cadres, civil servants, public employees, attracting talented people; policies on payroll, salary, income...
The urban government organization model in Hanoi makes the commune and ward government organization more streamlined and dynamic. Along with that, the government apparatus is more streamlined, the quality of public services, the quality of service to people and businesses is also improved.
Since implementing the urban government model, we, the judicial officers, have become more comfortable, confident and proactive in our work. As a result, serving and resolving problems for the people has become quicker and more transparent. Also from the joy and satisfaction of the people, we feel more motivated to contribute…”.
In addition, I think that the implementation of mobilization, rotation, and job transfer between civil servants in districts and wards is more flexible, proactive, and suitable, and the policies on salary and ranks are synchronized and improved due to the unification of one type of civil servant title, without distinction between district civil servants and ward civil servants.
The Law on the Capital (amended) passed by the National Assembly not only demonstrates the listening and acceptance of the opinions of National Assembly Deputies, but also demonstrates the continuous efforts in perfecting the legal system, towards the goal of building a civilized, modern and unique capital city of Hanoi.
With reasonable adjustments and high consensus, the Capital Law (amended) promises to be a solid legal corridor, creating a premise for the comprehensive development of Hanoi Capital in the future.

I am very excited that the amended Law on the Capital has been passed. I have closely followed the process of drafting the Law through the press and know that the 2024 Law on the Capital has many new points, creating a legal corridor for Hanoi to be the locomotive of development.
With the nature, requirements, and especially important position of the Capital, the focus on investment and development as a special urban area, a special administrative unit is suitable for the development requirements of the practical situation.
I see that Clause 2, Article 24 (Development of high-tech zones) of the Capital Law 2024 - a new point compared to the old Law - states: Hoa Lac High-tech Zone is an area for research, development, testing, application of high technology, training of high-tech human resources, production of high-tech products and key innovation of the country and the Capital; is a testing and piloting point for mechanisms and policies for the development of high technology and high-tech zones nationwide.
Hoa Lac High-Tech Park is allocated capital from the city budget to invest in the construction and development of Hoa Lac High-Tech Park, with priority given to investment in the system of technical infrastructure works; high-tech technical infrastructure and infrastructure serving the development of science and technology in Hoa Lac High-Tech Park; compensation, support, resettlement; construction of accommodation in accordance with the planning to arrange for workers working in Hoa Lac High-Tech Park to rent during working hours.
This is a superior and breakthrough policy for the city's development.

We all wish that Hanoi has a special mechanism to develop the Capital. The Capital Law is not only a law for a developing region, but will create the ability to attract the conditions and the quintessence of the whole country to the Capital, to create a representative image for the whole country.
The Law on the Capital (amended) was passed, we - the people living in Hanoi - feel very excited and expectant. I am interested in the field of education, because, compared to the current Law on the Capital, the Law on the Capital (amended) has made great strides in the policy of developing education and training. At any time, in any country, education is always the top national policy. Therefore, the Capital is the locomotive of the whole country in terms of economy and society, so first and foremost, it is necessary to build the Capital into a large, typical center of the whole country in terms of high-quality education and training.
