Employees take off on September 2nd, do businesses have to pay salaries?

National Day September 2 is one of the most important holidays of the year, awaited by many people not only because of its great historical significance but also because it is a time to rest and reunite with family. So according to the law, are employees who take a leave on September 2 paid by their employers?

According to Article 112 of the 2019 Labor Code, employees are entitled to take time off with full pay on major holidays, including National Day on September 2. Notably, from 2021, on National Day, employees will be entitled to 2 days off, including September 2 and an additional day before or after as prescribed by the Government annually.

This means that on September 2, workers will have at least two consecutive days off, both to rest and to facilitate travel, tourism or to return home to visit their families. This is also a humane policy to ensure the rights and care for the spiritual life of workers.

Regarding salary, according to Article 98 of the 2019 Labor Code, if an employee takes a day off according to the September 2nd holiday schedule, he/she will still be paid 100% of his/her salary according to the contract. In case the enterprise requires work on this day, the employee will be paid overtime at a rate of at least 300% of his/her salary, not including holiday pay. Thus, the total income can be up to 400% of salary/day, not including additional payments if working at night.

Employees working at night shall be paid an additional amount of at least 30% of their wages calculated according to the unit price of wages or actual wages paid for the work of a normal working day.

Employees working overtime at night, in addition to being paid according to regulations, will also be paid an additional 20% of their salary calculated according to the unit price of salary or salary according to the work done during the day of a normal working day or a weekly day off or a holiday.
