(NLĐO) – Leaders of the Son Tra District People's Committee, Da Nang City, have requested the Hyori building management board not to take over the work of state management agencies.

Regarding the case of Viet Nhat Kindergarten (Hioyri Building, Vo Van Kiet Street, Son Tra District, Da Nang City) appealing for help because the building's management board was obstructing educational activities and preventing the completion of fire safety measures, the authorities recently held a meeting to clarify several issues.

The meeting included representatives from the competent authorities of Da Nang City: the Department of Construction, the Economic Security Department of the Da Nang City Police, the Fire Prevention and Rescue Police Department of Da Nang City, the People's Committee of Son Tra District, the Son Tra District Police, the People's Committee of An Hai Dong Ward, representatives of the building's investor, and members of the building's management board.

The Viet Nhat Kindergarten is being prevented from completing fire safety work by the Hyori building management board, despite a prior directive from the Da Nang City Police.

At the meeting, Mr. Vo Kim Hoang – Deputy Head of the building's Management Board – maintained his stance, stating that the Viet Nhat Kindergarten must cease teaching and not continue renovations because its operations do not conform to the approved design.

Expressing his opinion, Mr. Tran Dinh Khanh – Head of the Housing and Real Estate Market Management Department of the Da Nang City Department of Construction – stated that the building's management board operates under the model of a Joint Stock Company's Board of Directors. Therefore, he requested that the building's management board fulfill its duties as stipulated in the 2023 Housing Law and Circular 05/2024/TT-BXD dated July 31, 2024, of the Ministry of Construction.

Mr. Khanh also affirmed that the areas for common and private use have been regulated in legal documents and contracts. "The Department of Construction previously agreed on the principle of adjusting the area for kindergartens. If apartment buyers have any issues, they will take the matter to court or commercial arbitration for resolution. Ownership in an apartment building is the responsibility of each individual, not the responsibility of the building management board," Mr. Khanh stated.

Lieutenant Colonel Tran Le Minh Dung, Deputy Head of the Fire Prevention and Rescue Police Department of Da Nang City Police, said that the investor had coordinated with the fire prevention and rescue police agency to carry out procedures for fire safety approval and acceptance. "The investor needs to coordinate with relevant agencies and implement the installation according to the approved documents in order to obtain fire safety acceptance," Lieutenant Colonel Dung said.

Meanwhile, Mr. Hoang Cong Thanh, Vice Chairman of the Son Tra District People's Committee, stated that according to the Management Board's working regulations, the Management Board needs to coordinate with local authorities to ensure security and order. However, the Ward People's Committee has repeatedly invited the Management Board to work with them, but the Management Board has not cooperated.

"If the investor makes any mistakes, citizens have the right to petition the state management agency for consideration and handling. We request that the Management Board not take over the work of the state management agency. We request that the police investigate and handle the actions of individuals causing a disruption of public order and security in the locality," Mr. Thanh emphasized.

Also at the meeting, Lieutenant Colonel Nguyen Nho Chinh - Head of the Economic Security Department of the Da Nang City Police - stated that the construction of fire protection systems is to ensure the safety of all people and property in the apartment building, and therefore needs to be carried out. Legal procedures will continue to be implemented according to regulations.

At the end of the meeting, the meeting chairman requested the Management Board to properly perform its functions and duties as stipulated in the Housing Law of 2023 (Articles 147, 148) and Circular No. 05/2024/TT-BXD.

At the same time, we request the Son Tra District People's Committee to inspect the building management board's operations to ensure compliance with legal regulations and to make recommendations for handling the building management board in accordance with the law.

In addition, it is requested that the Department of Construction and the City Police, based on their functions and duties, advise the City People's Committee on other matters related to construction permits and fire safety regulations for buildings. When citizens submit requests, the Department of Construction will also hold meetings with citizens to clarify relevant information.
