At the workshop to collect opinions on the draft Circular amending and supplementing Circular No. 09/2023/TT-NHNN dated July 28, 2023 guiding a number of articles of the Law on Anti-Money Laundering, organized by the State Bank on May 15, 2025, Ms. Nguyen Thi Minh Tho, Deputy Director of the Anti-Money Laundering Department, said: Amending and supplementing Circular No. 09/2023/TT-NHNN is an extremely urgent issue.
Because, one of the current work focuses is to implement the international commitments of the Vietnamese Government , especially related to Action No. 5: "Take action to address the shortcomings related to Vietnam's legal framework on regulations and requirements for FI and DNFBP supervision on anti-money laundering and terrorist financing; preventive measures, especially for recommendations 10, 11, 12, 16, 20 of the FATF standards". This is an important foundation to improve the effectiveness of anti-money laundering and terrorist financing work according to international standards.
Accordingly, many new regulations on anti-money laundering will be updated in the revised content, including: Article 3. Criteria and methods for assessing money laundering risks of reporting entities; Article 4. Process for managing money laundering risks and classifying customers according to the level of money laundering risk; Article 5. Internal regulations on anti-money laundering; Article 6. Reporting regime for large-value transactions that must be reported; Article 7. Reporting regime for suspicious transactions; Article 8. Electronic money transfer transactions; Article 9. Reporting regime for electronic money transfer transactions; Article 10. Form and deadline for reporting electronic data; Appendix. Amending Appendix 2 and adding Appendix 3...

In addition, the subjects subject to the amendment and supplementation of this Circular are determined to include the subjects specified in Circular No. 09/2023/TT-NHNN, which are financial institutions; organizations and individuals doing business in relevant non-financial sectors and professions; Vietnamese organizations and individuals, foreign organizations, foreigners, international organizations having transactions with financial institutions, organizations and individuals doing business in relevant non-financial sectors and professions; other organizations and individuals related to anti-money laundering.
According to the State Bank, in recent times, Vietnam's work to prevent and combat money laundering, terrorist financing and proliferation of weapons of mass destruction has achieved many positive results, reflected in both the completion of the legal framework and enforcement organization, both management and supervision activities, domestic implementation organization and international cooperation activities.
However, implementation practice has shown that some contents of Circular 09/2023/TT-NHNN need to be adjusted and updated to ensure better suitability with reality, while fully meeting international requirements, especially the recommendations of internationally recognized global standards on anti-money laundering and terrorist financing (FATF).
The representative of the Anti-Money Laundering Department added: The important difference in this draft compared to the current regulations in Circular No. 09/2023/TT-NHNN is not only the technical wording but can also have a significant impact on the subjects subject to regulation.
At the workshop, the State Bank affirmed that it will accept comments and complete the draft appropriately, ensuring that it meets both international compliance requirements and Vietnamese practice, minimizing unnecessary risks, while improving the effectiveness of anti-money laundering and anti-terrorism financing work, contributing to the safety and soundness of the financial system and economy . |
