Who is required to participate in fire and explosion insurance?

According to the Law on Fire Prevention, Fighting, and Rescue 2024, agencies, organizations, and individuals must participate in mandatory fire and explosion insurance for the assets of their facilities that are on the list of those requiring mandatory fire and explosion insurance.

This is not only a legal requirement but also a solution to minimize damage, quickly remedy the consequences when incidents occur, and ensure the stability of production and business operations.

Specifically, according to Article 48 of the Law on Fire Prevention, Firefighting and Rescue, it is stipulated that:

1. Agencies, organizations, and individuals must participate in mandatory fire and explosion insurance for the assets of facilities included in the list of facilities required to purchase mandatory fire and explosion insurance and comply with the provisions of the law on insurance.

2. Encourage agencies, organizations, and individuals to participate in mandatory fire and explosion insurance for assets of facilities not included in the list of facilities required to purchase mandatory fire and explosion insurance.

3. The Government shall prescribe the list of establishments required to purchase mandatory fire and explosion insurance; the contribution rates, management regime, and use of revenue from mandatory fire and explosion insurance for fire prevention, firefighting, rescue, and relief activities.

Appendix VII of Government Decree No. 105/2025/ND-CP, which details some provisions and measures for implementing the Law on Fire Prevention, Fighting, and Rescue, clearly stipulates 44 types of establishments that are required to purchase fire and explosion insurance, including:

1. Apartment buildings and collective housing with five or more floors or a total floor area of ​​1,000 m² or more.

2. Nurseries, kindergartens, and preschools with 50 or more children or a total floor area of ​​500 m² or more.

3. Primary schools, lower secondary schools, upper secondary schools, multi-level general schools, universities, colleges, vocational high schools, vocational training schools, technical worker schools, other educational institutions as prescribed by law on education, space research facilities, specialized database centers and other specialized research facilities with buildings of 3 stories or more or with a total floor area of ​​1,500 m² or more.

4. Hospital.

Clinics (general or specialized), health stations, maternity homes, disease prevention and control facilities, medical research and testing facilities, nursing homes, rehabilitation centers, orthopedic centers, elderly care facilities, and other medical facilities as defined by the Law on Medical Examination and Treatment that have buildings of 3 stories or more or a total floor area of ​​300 m² or more.

6. Stadiums with a seating capacity of 2,000 or more.

7. Sports arenas, training facilities, swimming pools, sports fields with grandstands, racetracks, shooting ranges, and other sports facilities established under the Law on Physical Education and Sports with 1,000 seats or more or a total floor area of ​​1,000 m² or more.

8. Theaters, cinemas, circuses.

9. Convention centers, museums, libraries, galleries, and exhibition halls with buildings of 3 stories or more, or with a total floor area of ​​500 m² or more.

10. Aquariums, karaoke establishments, dance clubs, entertainment and recreation establishments, performing arts venues, and other cultural activity establishments with two or more floors or a total floor area of ​​300 m² or more .

11. Markets, shopping centers, and supermarkets with a total floor area of ​​300 m² or more.

12. Food service establishments and other service establishments as prescribed by law with a total floor area of ​​300 m² or more.

13. Businesses dealing with flammable goods with a total floor area of ​​200 m² or more.

14. Business establishments dealing with non-flammable goods or non-flammable goods in flammable packaging with a total floor area of ​​1,000 m² or more.

15. Gas businesses with total gas storage exceeding 500 kg.

16. Gas station.

17. Hotels, guesthouses, motels, resorts, and other accommodation establishments with three or more floors or a total floor area of ​​500 m² or more.

18. Post offices, postal branches, and other postal and telecommunications service providers that are three stories or more in height, or have a total floor area of ​​500 m² or more.

19. Offices of state agencies, headquarters and workplaces of enterprises, political and social organizations with buildings of 3 floors or more or with a total floor area of ​​500 m² or more.

20. Multipurpose buildings, mixed-use buildings, excluding residential buildings combined with production or business activities, with buildings of 3 stories or more or with a total floor area of ​​500 m² or more.

21. Oil refinery; petrochemical plant; refining and petrochemical plant; gas processing plant; biofuel production plant; petroleum and petroleum product storage facility; liquefied natural gas storage facility; liquefied natural gas filling station; gas distribution station.

22. Power plant.

23. Substations with voltage of 110 kV or higher.

24. Establishments producing explosives, industrial explosive precursors, weapons, and supporting tools; fixed warehouses for storing explosives, industrial explosive precursors, weapons, and supporting tools.

25. Industrial production facilities with production support buildings classified as fire and explosion hazard categories A and B.

26. Industrial production facilities with production support buildings classified as fire hazard category C.

27. Industrial production facilities with production service buildings classified as fire hazard categories D and E, with a volume of 5,000 m³ or more, or a total floor area of ​​1,000 m² or more.

28. Warehouses storing goods classified as fire and explosion hazards A, B, C with a total floor area of ​​200 m² or more.

29. National reserves.

30. Warehouses storing goods classified as fire hazard D or E with a volume of 5,000 m³ or more, or with a total floor area of ​​1,000 m² or more.

31. Garages for cars and motorcycles, and showrooms for cars and motorcycles with a total floor area of ​​500 m² or more.

32. Water treatment plants, wastewater treatment plants.

33. Passenger terminals, diplomatic guesthouses, cargo terminals at airports; aircraft maintenance facilities; air traffic control towers.

34. Inland waterway ports and wharves; seaports classified as level III or higher according to the law on construction.

35. Inland port.

36. Type II fishing port.

37. Bus stations, vehicle inspection centers, and rest stops with a total floor area of ​​500 m² or more.

38. Passenger stations, freight stations, railway depots, cable car stations, urban railway stations, and passenger stations with a total floor area of ​​300 m² or more.

39. Road tunnels, railway tunnels, and urban railway tunnels with a length of 500 meters or more.

40. Road motor vehicle repair and maintenance facilities with a total floor area of ​​500 m² or more.

41. Facilities for repairing inland waterway vessels and seagoing ships with a total floor area of ​​1,000 m² or more.

42. Nuclear facilities.

43. Social assistance facilities with buildings of 3 stories or more, or with a total floor area of ​​300 m² or more.

44. Residential buildings combined with production and business activities, with a total area used for production and business of 200 m² or more.

In cases where agencies, organizations, or individuals violate regulations on fire and explosion insurance, they will be subject to penalties as stipulated in Article 17 of Government Decree No. 106/2025/ND-CP dated May 15, 2025, on administrative sanctions for violations in the field of fire prevention, firefighting, and rescue.   Specifically, as follows:

1. A fine of between VND 10,000,000 and VND 15,000,000 shall be imposed for any of the following acts:

a) Purchasing mandatory fire and explosion insurance at a premium rate lower than the mandatory fire and explosion insurance premium stipulated for facilities required to purchase such insurance;

b) Pay between 50% and less than 100% of the total amount allocated for fire prevention, firefighting, rescue, and relief activities from mandatory fire and explosion insurance as prescribed.

2. A fine of VND 20,000,000 to VND 30,000,000 shall be imposed for the act of paying less than 50% of the total amount allocated for fire prevention, firefighting, rescue, and relief activities from mandatory fire and explosion insurance as prescribed.

3. A fine of VND 30,000,000 to VND 40,000,000 shall be imposed for the act of failing to purchase mandatory fire and explosion insurance for facilities with fire and explosion hazards classified as Group 2 according to the law on fire prevention, firefighting, and rescue.

4. A fine of between VND 40,000,000 and VND 50,000,000 shall be imposed for any of the following acts:

a) Failure to purchase mandatory fire and explosion insurance for facilities with fire and explosion hazards classified as Group 1 according to the law on fire prevention, firefighting, and rescue;

b) Failure to pay the amount allocated for fire prevention, firefighting, rescue, and relief activities from mandatory fire and explosion insurance as prescribed.
