Decentralization of vehicle inspection management, local authorities worry about 'not enough people to do it'

On June 8, Decree 30 amending and supplementing a number of articles of Decree 139 regulating the business of motor vehicle inspection services officially took effect.

One of the new points in Decree 30 is the clear and transparent decentralization of State management responsibilities at the central and local levels in licensing and managing inspection units and inspectors.

Accordingly, Decree 30 stipulates that the Vietnam Register will no longer be responsible for issuing Certificates of eligibility to operate motor vehicle inspections to inspection centers nationwide.

Instead, the Department of Transport will perform this task at the inspection units in the area. The application for establishing an inspection center and procedures related to inspection activities will be transferred to the Department of Transport for settlement instead of the Inspection Department as before.

In addition, the Department of Transport will be responsible for inspecting and supervising the operations of local inspection centers.

At the conference to disseminate Decree 30 amending and supplementing a number of articles of Decree 139 on motor vehicle inspection service business recently organized by the Vietnam Register, there were concerns about this decentralization.

Accordingly, many localities said that the current workload is very large, and continuing to "shoulder" the additional task of managing vehicle inspection activities while the number of staff is not increased will be very difficult for the staff.

Citing local examples, a representative of the Department of Transport of Ba Ria-Vung Tau province said that the province will assign the vehicle inspection field to the driver management department.

However, the department's current staff is "very thin". The Driver Vehicle Management Department has 5 people including 1 department head, 1 deputy department head and 3 employees.

The department has only 3 employees who perform the tasks of managing vehicles and drivers, driver training, and now vehicle inspection with a large workload (appraisal, licensing (establishing a council), inspection, supervision of vehicle inspection centers)... which is very heavy.

Sharing the same concerns, the leader of the Department of Transport of Thua Thien - Hue province also raised the issue: In Official Dispatch No. 9128 dated June 13, 2023 of the Ministry of Transport, there is a content: In case the Department of Transport is not qualified to perform the tasks of Decree 30, there will be a document requesting the Vietnam Register to continue to perform...".

"However, Decree 139 and Decree 30 do not clearly state what these conditions are. Please clarify," said a representative of the Thua Thien - Hue Department of Transport.

Responding to these concerns, the Vietnam Register said that at Point d, Clause 2, Article 3 of Decree 30, it stipulates that from the effective date of this Decree, if the Department of Transport has not yet performed these tasks, it will send a written request to the Vietnam Register to continue performing them.

"The conditions here are the human resource conditions of the Department of Transport to implement the regulations in the decree," said a representative of the Department of Registration.

Mr. Nguyen Chien Thang, Director of the Vietnam Register, also answered concerns about the personnel to establish an appraisal council to certify qualified registration facilities and evaluate the maintenance of local registration units.

According to Mr. Thang, Decree 30 clearly stipulates that the Department of Transport is the focal point and takes the lead in implementation. In addition, there needs to be coordination between the Department of Natural Resources and Environment, Department of Construction, Department of Science and Technology, Department of Labor - Invalids and Social Affairs, and Tax Department to evaluate all items (land, construction location, inspection equipment, human resources, taxes, etc.) in accordance with the law.

Mr. Thang also noted that when tasks arise, the Department of Transport should not create additional organizational apparatus to carry out the tasks.
