
Continuing the 50th session of the National Assembly Standing Committee, on the morning of October 9, under the direction of Vice Chairman of the National Assembly Nguyen Duc Hai, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Prices.

Do not extend the inspection period compared to current regulations
The draft Law on amending and supplementing a number of articles of the Law on Prices was presented by Minister of Finance Nguyen Van Thang and stated that the draft Law has reduced the conditions for granting certificates of eligibility to conduct valuation services, including abolishing the regulation that in case the capital contributing member is an organization, the authorized representative of the capital contributing organization must be a person with a price appraiser card, helping to simplify administrative procedures for capital contributing organizations, thereby reducing costs of complying with administrative procedures.

The Draft Law does not contain any content on decentralization and delegation because the 2023 Law on Prices has fully implemented the policy of strengthening decentralization and delegation from the central government to localities and by sector and field in state management of prices.
Accordingly, the Government will orient the general price management and operation goals; the authority and responsibility for price management, regulation, and price appraisal management will be implemented by ministries, branches, and localities to ensure increased division of work and decentralization, in accordance with assigned functions and tasks.
According to the Review Report on the draft Law amending and supplementing a number of articles of the Law on Prices presented by Chairman of the Economic and Financial Committee Phan Van Mai, the majority of opinions agreed with the necessity of promulgating the Law amending and supplementing a number of articles of the Law on Prices to conform to the current organizational model, implementing the Party and State's policy of perfecting institutions, promoting decentralization and delegation of power, promptly handling practical issues, perfecting and ensuring the consistency of the legal system.

Regarding the inspection period, the Economic and Financial Committee found that the draft amended Law, which stipulates an extension of the inspection period compared to current regulations, is not consistent with Resolution No. 68-NQ/TW dated May 4, 2025 of the Politburo on private economic development "Ending the situation of overlapping, duplicative, prolonged inspections and examinations..." and the provisions in Article 68 of the current Law on Prices "Limiting obstructions and impacts on the activities of inspected subjects" . Therefore, it is recommended to review and stipulate an appropriate inspection period, not longer than current regulations.
Detailing the responsibility for price stabilization at the commune level
Commenting at the meeting, National Assembly Chairman Tran Thanh Man stated that the Law on Prices was passed by the National Assembly on June 19, 2024, effective from July 1, 2024. After more than a year of implementation, the amendment is now to conform to the arrangement of the two-level government apparatus.
The National Assembly Chairman emphasized that the amendments and supplements should focus on the goal of perfecting the socialist-oriented market mechanism, strengthening state management of prices and price appraisal, while protecting consumer rights and stabilizing price management and regulation; price stabilization, state pricing, price negotiation, price declaration and posting; price synthesis, forecasting and price database as well as paying attention to appraisal, inspection and specialized examination activities...

According to the National Assembly Chairman, the amendment needs to be in the direction of overcoming some shortcomings in one year of law enforcement, in line with the two-level government model; strengthening decentralization, improving management discipline and updating the list of goods priced by the State.
"The State must always manage the market, not letting prices increase. If prices increase, the State must take responsibility, because our country's mechanism is a market economy with State management, following the socialist orientation, under the leadership of the Party," the National Assembly Chairman emphasized.

The National Assembly Chairman said that the main changes focus on expanding the scope of specialized inspections; detailing the responsibility for price stabilization at the commune level; clarifying the conditions for price appraisal enterprises; adding specialized inspections, updating the names of ministries, branches, and appendices to the list... "We must be very clear and specific," the National Assembly Chairman requested.
National Assembly Chairman Tran Thanh Man noted that the amendments and supplements need to ensure consistency with laws passed by the National Assembly; research regulatory solutions to contribute to promoting decentralization, delegation of power, cutting and simplifying administrative procedures, and limiting impacts on business operations.

The National Assembly Chairman requested clarification of the reason for extending the inspection period for compliance with price laws from 10 days to 15 days, because the extension will be difficult for businesses.
In terms of scope, the draft Law removes the content of specialized price inspection, and at the same time removes specific regulations related to specialized price inspection in specific articles and clauses, to ensure consistency with the 2025 Law on Inspection.
Chairman of the Law and Justice Committee Hoang Thanh Tung pointed out that the organizational structure, functions and tasks of specialized inspectors under the provisions of the Law on Inspection have changed significantly. Accordingly, the Ministry of Finance no longer has a specialized price inspection agency, the function of specialized price inspection in particular and specialized inspection in all fields in general has been transferred to the Government Inspectorate.

The Chairman of the Committee on Law and Justice said that if all regulations related to specialized price inspections are removed, on what legal basis will the Government Inspectorate conduct specialized price inspections?
Therefore, the Chairman of the Law and Justice Committee proposed that the draft law still maintain the current scope of regulation with the content of specialized price inspection, only changing the phrase "specialized price inspection" to the phrase "inspection in the field of prices" to ensure the legal basis for the Government Inspectorate to implement.
Concluding the discussion, Vice Chairman of the National Assembly Nguyen Duc Hai stated that, in order to ensure the quality of the draft law, the Government should continue to review to ensure full institutionalization of the Party's policies, ensure that the provisions of the law comply with the Constitution, are consistent with international commitments, and are consistent with other laws, especially those with price regulations. Review and amend the law to meet the current organizational model, promote decentralization and delegation of power, promptly handle practical issues, and resolve difficulties and obstacles.
