Regarding the case of Ms. Pham Thi Hoa, Vice Chairman of the People's Committee of Ha Dong District, who had decided to resign but still worked, on November 9, Ms. Hoa filed a complaint to the Hanoi People's Committee. The content was to complain about the process of handling the petition, issuing Decision No. 5600 dated November 2 of the City People's Committee.
In the application, Ms. Hoa said that on August 3, she submitted an application for early retirement. However, since the date of submitting the application, she has not been met by any official or organization, discussed, understood her thoughts and wishes, or given guidance on the State's regulations and policies regarding her case.
"I have not yet received any comments from the competent authority regarding whether or not my request is approved. On November 6, I was suddenly notified by the People's Committee of Ha Dong District and given a decision by the People's Committee of Hanoi City on my resignation, without announcement, without giving the decision, without encouraging or recognizing my individual contributions to the common task," Ms. Hoa stated in her complaint.

According to her, the process of processing the application and issuing the Decision on her dismissal did not ensure publicity, transparency, and democracy, affecting the rights of the individual. Therefore, the Vice Chairman of the People's Committee of Ha Dong District requested the People's Committee of Hanoi City to comply with regulations.
Regarding the application for early retirement sent on August 3, Ms. Pham Thi Hoa said that she had presented that the arrangement of her rotation to the base in Duong Noi ward was not in line with the Party's policy on training cadres and strengthening cadres and leaders for key units with many complicated cases.
According to Ms. Hoa, she is 54 years and 5 months old, and her working time is not enough for half of her term, so it is not enough to do a good job in a new task, helping a key locality. Thus, the goal of rotating and strengthening cadres for the Party's grassroots will not be effective.
Along with that, she said that there is not much time left from now until the Party Congresses at all levels for the 2025-2030 term, so transferring her to join the Duong Noi Ward Party Committee will be difficult in arranging personnel for the next term of the grassroots Party Committee.
"I respectfully request the Hanoi City Party Committee, Hanoi People's Committee, and the Standing Committee of the Ha Dong District Party Committee to consider allowing me to take early retirement. Thus, my request for retirement is because the district plans to arrange for me to do other work that I find unsuitable for me, so I request to take early retirement, also known as early retirement," according to the content presented by Ms. Hoa.
However, Decision No. 5600 dated November 2 of the Hanoi People's Committee on Ms. Pham Thi Hoa's resignation was based on Decree No. 46 regulating termination of employment and retirement procedures for civil servants.
Thus, this decision is essentially to let Ms. Hoa quit her job and receive severance pay, which is not in accordance with the individual's previous request.
"After nearly 34 years of work, what is my "status" after receiving Decision 5600? Leader? Officer? Retired? Or a citizen voluntarily paying social insurance? I request that the Hanoi People's Committee let me retire according to Decree 29 of the Government , which is more appropriate," Ms. Hoa stated in her complaint.
Along with that, she complained about the issuance time and the statute of limitations of Decision No. 5600. Specifically, the Decision to terminate her employment was signed and issued on November 3 but took effect from November 1.
Therefore, on November 1-3, Ms. Hoa still worked, handled, directed and operated normal tasks at the agency and attended city meetings as assigned by the Chairman of the People's Committee of Ha Dong District.
Ms. Hoa also said that after the above information was reported, many people misunderstood, seriously affecting her reputation and personal honor. Based on the above content, Ms. Hoa filed a complaint, requesting the agencies to investigate, verify and revoke Decision No. 5600 of the Hanoi People's Committee.
On the same day, a representative of the city's Citizen Reception Committee said that they had received Ms. Hoa's application and would study, classify, and process it according to the procedure.
As reported by Dan Tri newspaper, units of Ha Dong district are reviewing the case of Ms. Pham Thi Hoa, Vice Chairman of the District People's Committee, who was suspended from work but still went to work and signed dozens of documents on November 1-3.
For now, the district leader said that the decision to dismiss Ms. Pham Thi Hoa was issued by the Hanoi People's Committee, but it was not until November 3 that the decision was transferred to the district.
Meanwhile, Ms. Hoa did not know that she had been laid off since November 1. Therefore, she still received work assigned by Ha Dong district, and documents were still submitted for Ms. Hoa to process and sign on November 1-3.
