One of the important items on the agenda of the 5th Session is the National Assembly's consideration and adoption of the draft Resolution on conducting votes of confidence and no-confidence votes for office holders elected or approved by the National Assembly and People's Councils (amended) using a simplified procedure to replace Resolution No. 85/2014/QH13 dated November 28, 2014.
The Standing Committee of the National Assembly will submit the draft to the National Assembly in the afternoon session tomorrow (May 30) before National Assembly deputies discuss it in groups. This content will be discussed in the plenary session on the afternoon of June 9 and considered for a vote on its adoption on the afternoon of June 23.

"The National Assembly is studying amendments to Resolution 85 to ensure early, thorough, and meticulous preparation for the confidence vote in the National Assembly and People's Councils," emphasized National Assembly representative Trinh Xuan An ( Dong Nai delegation) - a full-time member of the National Assembly's Committee on National Defense and Security. He added that the draft, prepared by the Committee on Representative Affairs, will be submitted to the National Assembly Standing Committee for comments, with specific conclusions to further refine the regulations.
The purpose of drafting this resolution is to promptly institutionalize Regulation No. 96-QD/TW dated February 2, 2023, of the Politburo on conducting confidence votes for leadership and management positions in the political system, and Resolution No. 27-NQ/TW dated November 9, 2022, of the 6th Plenum of the 13th Central Committee of the Communist Party of Vietnam on continuing to build and perfect the socialist rule of law in Vietnam in the new period; ensuring the consistency of the legal system in the context that in recent years the National Assembly has amended and supplemented several laws with content related to confidence votes in the National Assembly and People's Councils.
Furthermore, Resolution No. 85/2014/QH13 dated November 28, 2014, of the National Assembly, during its implementation, has revealed some shortcomings and limitations that need to be addressed promptly. For example, it previously only stipulated the consequences for those subject to confidence votes, but did not specify a timeframe for implementation, leading to discretionary and inconsistent practices nationwide. Similarly, the reporting form for those subject to confidence votes is too general and not specific enough, making it difficult for delegates to assess the level of confidence.
Mr. Trinh Xuan An stated that National Assembly delegates highly appreciate Regulation No. 96 of the Politburo, which has many new points demonstrating the decisive and direct approach of confidence votes in evaluating officials and the effectiveness and efficiency of the state apparatus; creating a ripple effect, especially after the Central Committee held a confidence vote for Politburo members and Secretariat members of the 13th term at the recent mid-term conference.
Assessing the presentation of the draft resolution to the National Assembly at the 5th Session as a proactive and thorough preparation, closely adhering to Regulation 96, Mr. Trinh Xuan An believes that the vote of confidence in the National Assembly will have a widespread impact and create a certain mark because it demonstrates the role of the highest state power organ.
From the perspective of a National Assembly representative – someone who will represent voters in discussions, pass resolutions, and directly cast their ballots to express their opinions – Mr. Trinh Xuan An expressed concern about the preparation process to ensure that representatives have sufficient information to make accurate, correct, and comprehensive assessments of the subjects being evaluated, avoiding opinions that suggest a lack of objectivity or subjectivity.
"A fair, objective, thorough, and comprehensive assessment that leaves no one in a 'danger zone' is ideal. Even if some officials receive a high number of 'low confidence ratings,' this is still an accurate assessment by the National Assembly. With the National Assembly's current working methods of being fair, objective, and closely monitoring the performance of those elected and approved by the National Assembly, good preparation helps ensure a complete and accurate assessment," said Mr. Trinh Xuan An.

Also commending the preparations for the confidence vote, National Assembly representative Pham Van Hoa – Deputy Head of the National Assembly Delegation of Dong Thap province – said that, first and foremost, it demonstrates the National Assembly's sense of responsibility towards those elected or approved to hold office; contributing to assessing their prestige and the results of fulfilling their assigned duties and responsibilities.
According to him, those who receive a high level of confidence should continue to excel, while those whose confidence is not high should reflect on themselves to better perform their assigned tasks.
"Taking a vote of confidence demonstrates a high sense of responsibility, enabling leaders to better manage and develop the country's socio-economic affairs. It provides a very good foundation for achieving the goals and targets set for the term," Mr. Pham Van Hoa emphasized.
The representative also stated that the National Assembly will thoroughly discuss and finalize the regulations before promulgation. Besides the responsibilities of National Assembly representatives, it is crucial to have a reliable information channel with quantitative data to objectively and accurately assess the subjects of the confidence vote.
According to regulations, the National Assembly and People's Councils hold a vote of confidence once during each term, at the regular session at the end of the third year of the term. The 15th National Assembly will hold a vote of confidence for those holding positions elected or approved by the National Assembly at its 6th session at the end of this year.
