Specific regulations on individuals and organizations allowed to exploit medical data

Decree No. 102/2025/ND-CP stipulates that Party, State, Fatherland Front and socio-political organizations are allowed to exploit and use medical data in accordance with their functions and tasks.

The Government has just issued Decree No. 102/2025/ND-CP regulating the management of medical data.

Accordingly, the Decree stipulates digital health data including the construction, development, protection, administration, processing, and use of digital health data; the national health database; and the responsibilities of relevant agencies, organizations, and individuals in the management of digital health data.

The Decree stipulates that digital health data is digital data reflecting health fields (health data). Regarding the scope of health data, the Decree stipulates that health data reflects information on 24 health fields.

In addition, the above decree also stipulates medical databases, specifically: National medical database; Specialized medical database; Medical database of other levels of government, medical facilities containing medical information and data under their management; Shared medical database including national medical database and specialized medical database.

For the subjects exploiting and using medical data, the Decree stipulates that Party, State, Fatherland Front agencies and socio- political organizations are allowed to exploit and use medical data in accordance with their functions and tasks.

In addition, organizations and individuals are allowed to exploit and use "open data" on healthcare; with the consent of the data management and maintenance unit, the individual is the data subject; exploit and use other data with the consent of the data management and maintenance unit.

The Decree also specifically regulates the use of medical data to deploy electronic health books in medical examination and treatment; the responsibilities of medical facilities in connecting, sharing, and interoperating medical data related to electronic health books integrated on VNeID; citizens using VNeID to replace related documents in the process of medical examination and treatment...

The Decree takes effect from July 1, 2025./.
