Inappropriate regulations, localities wait for special mechanisms

On the morning of May 25, the National Assembly discussed in the hall the Report of the Supervisory Delegation and the draft Resolution of the National Assembly on the results of the thematic supervision of "the implementation of Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and monetary policies to support the Socio -economic Recovery and Development Program and the National Assembly's resolutions on a number of important national projects until the end of 2023".

Projects with special mechanisms are implemented quickly.

Speaking at the meeting hall, delegate Hoang Van Cuong - National Assembly Delegation of Hanoi City expressed his agreement and highly appreciated the report of the Supervisory Delegation which had fully and comprehensively assessed the achieved results, shortcomings, limitations and causes, pointed out responsibilities and proposed very specific recommendations on what needs to be done after the supervision.

Through monitoring, delegate Hoang Van Cuong realized that programs and projects with special mechanisms and policies attached have removed many difficulties, helping projects to be implemented quickly like important national projects that are assigned to contractors, and construction material mines are exploited without permission, so although these projects have large total investment, there are many inherent problems such as site clearance, but most of these projects are implemented very quickly, while many projects do not have to clear the site, but because there is no special mechanism, the implementation is slow, many projects even have to be abandoned and cannot be implemented, many units have to return capital, although these units really need such projects.

“ Thus, no matter how complicated the project is, if there is a special mechanism that allows to ignore unnecessary regulations and is implemented in a way that is suitable for reality, no matter how difficult it is, it can still be implemented. Meanwhile, if the project is very necessary but must comply with current regulations, it is not certain that it can be implemented, ” emphasized delegate Cuong.

According to the delegate, the actual implementation of the projects has many things that need to be done to suit the reality for better efficiency, but currently they are not recorded in the specific mechanism, so many projects are having to stop and wait.

Delegate Hoang Van Cuong gave the example of the Khanh Hoa - Buon Ma Thuot Expressway Project: “ To build a road, people have to remove the top layer of cultivated land. If this land is used to fill the construction material mine, it will become a very good cultivated area. However, it is not done like that but still has to concentrate in the construction material mine area and this is very unreasonable .”

For the Hanoi Capital Ring Road 4 project, all the most difficult stages such as site clearance have been resolved very quickly, and the implementation of parallel access roads has been basically completed one year ahead of schedule.

However, the main project of building a highway cannot be implemented for bidding because it must be invested in the form of public-private partnership and domestic bidding, while domestic capital is very limited. If we want to attract foreign investors, we must have mandatory conditions for using advanced technology and international management experience.

The Ring Road 4 project does not require any special technology or international engineering, and it is not a project that affects national security. The most important condition here is that the project needs to attract contractors with sufficient financial capacity to implement it.

Accordingly, delegate Hoang Van Cuong proposed that it is necessary to add to the resolution on supervision of Ring Road 4 in the Capital region, allowing domestic investors to form joint ventures with foreign investors, in which the domestic investor will be the head of the joint venture.

The National Assembly needs to have a Resolution allowing officials to apply and be flexible in performing their duties.

The delegate also affirmed that in reality, there are many regulations that are not suitable for reality. Everyone sees the need to do things differently from the new regulations to be suitable for reality and effective, but in reality, when performing official duties, the enforcers still have to comply with the regulations and perform inappropriate actions, many people even do not dare to do it, and have to push the responsibility to higher levels.

This may lead to localities waiting to request special mechanisms to resolve the issue. In the recent past, almost every session of the National Assembly has considered and approved resolutions on special mechanisms and policies. In this session, the North-South Expressway in the West also proposed a special mechanism, as did Nghe An and Da Nang provinces.

" I believe that localities, sectors and fields will continue to ask for special mechanisms in the upcoming sessions ," the delegate affirmed.

To overcome the current situation of officials being rigid and not daring to act for fear of making mistakes, and at the same time encourage officials to be proactive and creative in performing their duties, delegates suggested that the National Assembly should have a resolution allowing them to apply legal provisions when performing their duties or choose the most appropriate, flexible, and creative legal provisions to suit the subjects, conditions, and actual circumstances.
