In the case of a student who is receiving a salary and submits an application for admission to a university, the application includes proof that he or she is currently working for a salary to be eligible for bonus points for the entrance exam score, but when the admission notice is received, the student submits a resignation letter at the workplace. Then the student submits an application for tuition exemption because he or she is the child of a war invalid or martyr.
So, how should this case be resolved? In the case of a poor or near-poor household, requesting documents from the local authority but requesting tuition fee exemption, the local authority issues a certificate of poor household but it is not true, how should this case be resolved, or should we just base on the existing documents to implement? On September 3, 2025, the Government issued Decree No. 238/2025/ND-CP replacing Decree No. 81/2021/ND-CP dated August 27, 2021 regulating the mechanism for collecting and managing tuition fees for educational institutions in the national education system and policies on tuition exemption and reduction, support for learning costs; service prices in the field of education and training. Some of the provisions are as follows:
Clause 5, Article 19 of Decree No. 238/2025/ND-CP stipulates: “Tuition exemption, reduction, or support shall not be applied to those who are receiving salary or living expenses while studying, or to graduate students or doctoral students (except for those specified in Clause 9, Clause 11, Article 15 and Point b, Clause 3, Article 16 of this Decree)”.
Thus, except for the subjects specified in Clause 9, Clause 11, Article 15 and Point b, Clause 3, Article 16 of Decree No. 238/2025/ND-CP, students who fall into one of two cases: receiving salary or receiving living expenses while studying are not entitled to tuition exemption or reduction policies.
Clause 6, Article 19 of Decree No. 238/2025/ND-CP stipulates: “The tuition fee exemption, reduction, and support regime shall not apply to learners who have enjoyed this regime at a vocational education institution or higher education institution and now continue to study at another vocational education institution or higher education institution of the same level and training level. If a learner is eligible for tuition fee exemption or reduction and simultaneously studies at many educational institutions or many faculties and majors in the same educational institution, he/she shall only enjoy one tuition fee exemption or reduction regime.”
Ms. Tran Thi Ngoc Lan is requested to compare with the above regulations. If she meets the conditions, she will be entitled to tuition exemption and reduction policy.
