In the case of a student who is currently employed and submits an application to a university, including proof of employment to qualify for bonus points on the entrance exam, but upon receiving the acceptance notification, the student resigns from their job. Subsequently, the student applies for tuition fee exemption because they are the child of a war invalid or martyr.

So, what's the solution in this case? If a person is from a poor or near-poor household and requests supporting documents from the local authorities for tuition fee exemption, but the local authorities issue a certificate of poverty that is inaccurate, how should this be handled? On September 3, 2025, the Government issued Decree No. 238/2025/ND-CP, replacing Decree No. 81/2021/ND-CP dated August 27, 2021, which regulates the mechanism for collecting and managing tuition fees for educational institutions within the national education system and policies on tuition fee exemption and reduction, support for learning costs; and service prices in the field of education and training. Some of the regulations included are as follows:

Clause 5 of Article 19 of Decree No. 238/2025/ND-CP stipulates: “Tuition fee exemptions, reductions, and support shall not apply to cases where individuals are receiving salaries or living allowances while studying, or to postgraduate and doctoral students (except for those specified in Clauses 9 and 11 of Article 15 and Point b, Clause 3 of Article 16 of this Decree).”

Therefore, except for the subjects specified in Clauses 9 and 11 of Article 15 and Point b, Clause 3 of Article 16 of Decree No. 238/2025/ND-CP, students who are either receiving a salary or receiving a living allowance while studying are not eligible for tuition fee exemption or reduction policies.

Clause 6, Article 19 of Decree No. 238/2025/ND-CP stipulates: “The tuition fee exemption, reduction, and support scheme shall not apply to learners who have already received such benefits at one vocational education institution or higher education institution and are now continuing their studies at another vocational education institution or higher education institution of the same level and training qualification. If a learner eligible for tuition fee exemption or reduction is simultaneously studying at multiple educational institutions or multiple faculties/majors within the same educational institution, they shall only be entitled to one tuition fee exemption or reduction scheme.”

We request that Ms. Tran Thi Ngoc Lan compare her situation with the above regulations; if she meets the conditions, she will be eligible for tuition fee exemption or reduction.
