In the past 3 months, according to Tuoi Tre Online, in some localities, many people have requested to withdraw their application to convert agricultural land to residential land because the land use fee is too large, beyond their financial capacity.
In fact, some households have to pay several billion, even up to 50 billion VND, depending on the area of agricultural land requested to be converted to residential land.
The Land Registration Office allows people to withdraw their applications at their request. However, in the case of a household in Lam Dong , although they withdrew their application for a land use right certificate (red book), the tax authority still suspended the financial obligation as previously announced.
Explaining the regulations on determining and notifying the collection of financial obligations for land users and owners of assets attached to land, the Tax Department ( Ministry of Finance ) said that based on the provisions of the Land Law, Decree No. 126/2020, ... taxpayers submit dossiers to determine financial obligations on land use fees at the dossier receiving agency under the one-stop mechanism where the land is located (natural resources and environment agency).
Tax authorities shall base on the information transfer form to determine financial obligations on land and accompanying documents to determine financial obligations for taxpayers.
If the environmental resources agency determines that the file is eligible for withdrawal/cancellation and requests the withdrawal or adjustment of the information transfer form, the tax agency shall adjust the financial obligation notice according to the request of the environmental resources agency.
And from August 1, 2024, according to Decree 103/2024 regulating land use fees and land rents, tax authorities will base on the information transfer form and accompanying documents transferred by the land registration office or the competent land management agency or the one-stop-shop department to determine the financial obligations for land use fees of households and individuals.
Thus, in case of any change in information regarding the determination of financial obligations, the land registration office or the competent land management agency will transfer the information to the tax authority.
To resolve the situation of withdrawing documents but still being charged land use fees, the Tax Department said it has exchanged electronic information with the Department of Natural Resources and Environment (now the Department of Agriculture and Environment) on receiving and returning results of administrative procedure files related to land.
Accordingly, receiving and returning results to people is done at the agricultural and environmental agency.
In the coming time, the Tax Department will continue to coordinate with the national data center and the Ministry of Agriculture and Environment to redesign the process and implement the interconnected administrative procedures on land on the National Public Service Portal according to the upgrade roadmap of this portal.
