According to the official document, the 2024 Land Law and its implementing decrees contain many provisions that empower provincial People's Councils and People's Committees to issue detailed regulations and guidelines for implementation, tailored to the specific conditions of each locality.
In the past, localities have focused all resources on developing and issuing documents as required. However, after the merger of provinces and cities, inconsistencies may arise within each province or city regarding certain specific regulations.
Specifically, according to the Ministry of Agriculture and Environment , inconsistencies in regulations appear in the following areas: timeframes for processing administrative procedures, compensation levels for livestock and crops, support for stabilizing livelihoods and production, minimum resettlement quotas, compensation rates for damages when the State reclaims land; land allocation limits, and recognition of land use rights.
Furthermore, the minimum conditions and area requirements for land subdivision and consolidation for each land type, or the criteria for deciding on bidding to select investors for land-use investment projects, can also lead to comparisons of advantages and disadvantages between communes, wards, or land users, thereby creating difficulties for local land management.
To proactively address these shortcomings, the Steering Committee for the implementation of the Project on the reorganization and consolidation of provincial-level administrative units, the People's Councils, and the People's Committees of provinces and cities need to direct specialized agencies to proactively review the contents assigned to them for detailed implementation of the Land Law and the decrees detailing its implementation within their authority, in order to amend and supplement them in a way that unifies the application or regulates the application of specific policies in the merged localities.
In particular, the Ministry of Agriculture and Environment requested the Steering Committee for the implementation of the Project on the rearrangement and consolidation of provincial-level administrative units and localities to have transitional regulations to implement land policies in the province when the merged provincial-level administrative unit comes into operation, ensuring no disruption, no legal vacuum, and no impact on the legitimate rights and interests of land users.
