Will strengthen handling of abuse of livestream and e-commerce applications to trade in counterfeit and fake goods

Emphasizing that dealing with commercial fraud, counterfeit goods, and fake goods in the e-commerce environment is still difficult, Minister of Industry and Trade Nguyen Hong Dien said that in the coming time, he will actively and proactively review and handle the abuse of livestreams and e-commerce websites and applications to trade in counterfeit, fake, and poor-quality goods.

Building an E-Commerce Law to Strengthen Market Management

On the afternoon of June 17, speaking at the National Assembly's discussion session on socio -economic issues, Minister of Industry and Trade Nguyen Hong Dien explained and clarified the opinions of National Assembly deputies on the management of the industry and trade sector.

Regarding the issue of market inspection and control, anti-counterfeiting, and consumer rights protection, the Minister agreed with the opinions of delegates that although ministries and local branches have made great efforts in the fight against counterfeit and poor quality goods and achieved results, this problem is still very complicated.

According to the Minister, the reason is that the business of counterfeit goods is very profitable, attracting many participants; violations are increasingly sophisticated, taking advantage of high technology to commit fraud in the e-commerce environment.

In addition, the human and material resources of the authorities are still limited, and coordination between agencies is sometimes not synchronized. On the other hand, current laws, mechanisms, and sanctions are not enough to deter; a number of officials in some sectors and fields are given responsibility but are degenerate, corrupt, and assist in violations.

To overcome this situation, Minister Nguyen Hong Dien stated that in the coming time, the Ministry of Industry and Trade will continue to advise on perfecting legal policies, clearly defining the authority and responsibilities of ministries, branches, localities, functional agencies and inter-sectoral coordination mechanisms, enhancing the effectiveness and efficiency of supervision and inspection work.

The Ministry will also submit to the National Assembly for approval the Law on E-commerce to strengthen management, expected to be presented at the upcoming 10th Session.

Along with that, it will enhance the responsibility for performing public duties, strengthen mandatory inspection and post-inspection, perfect the mechanism to support local market management forces to fulfill their assigned tasks well; propose to apply sanctions that are strong enough to deter violators; promote dissemination, propaganda, and guidance for businesses and business households to comply with the law and advise consumers to consume wisely.

Regarding the issue of handling commercial fraud, counterfeit goods and fake goods in the e-commerce environment, the Minister assessed that controlling and handling counterfeit goods and fake goods in the online environment is always difficult, because many items are complicated, the technology is sophisticated, the inspection force and means are limited, and the coordination of many different specialized agencies is required.

Meanwhile, current laws do not have specific regulations on sanctions for new sales and advertising models, and existing sanctions are not strong enough.

To overcome the above situation, the Minister said that in the coming time, the Ministry of Industry and Trade will urgently complete the dossier and draft Law on E-commerce, and submit it to the Government and the National Assembly. The Minister added that at the end of this afternoon, the Prime Minister will listen to the draft Law to submit it to the National Assembly in the coming days.

Along with that, the Ministry of Industry and Trade proposed clarifying the responsibilities of ministries, branches, localities, and functional agencies with e-commerce models and livestream sales entities.

The Minister said that he will decentralize authority to localities in managing e-commerce transactions, continue to coordinate with specialized units in inspecting and handling violating items, in addition to actively and proactively reviewing and handling the abuse of livestreams and e-commerce websites and applications to trade in counterfeit, fake, and poor-quality goods.

In addition, promote propaganda, dissemination, and guidance for people and businesses to only buy products with clear origins and guaranteed quality; strengthen connections and data sharing among ministries, branches, and localities; coordinate with the National Steering Committee 389 and the Ministry of Public Security to review information and prevent counterfeit, fake, and poor-quality goods.

Efforts to implement solutions to expand the market for Vietnamese goods

Regarding the situation of agricultural exports in the context of pressure from reciprocal tax measures. The Minister said that according to customs data, the export of agricultural and aquatic products in the first four months of this year reached 13.72 billion USD, up 14.8% over the same period last year.

Mr. Dien affirmed that in recent years, even before the pressure from the US countermeasures appeared, the Prime Minister directed the Ministry of Industry and Trade to make efforts to implement a number of solutions to find and expand markets for Vietnamese goods in general and agricultural and aquatic products in particular.

Accordingly, focus on improving the quality of forecasting fluctuations in the world market, updating information on production and import-export strategies of key markets; organizing monthly trade promotion conferences for businesses and industry associations to participate and share information.

The Ministry also coordinates with relevant ministries and sectors to continue negotiating to remove non-tariff technical barriers, expand export markets to potential markets, especially agricultural products in the US, Europe, Japan, Canada, South Korea, Australia, along with promoting trade in potential markets such as the UK, France, the Netherlands and West Asian countries; continue to promote the export of goods to the Chinese market in the form of official channels.

In addition, promote negotiations on free trade agreements, request partners to open markets, cut tariffs on goods, including Vietnamese agricultural products; strengthen direct and online trade promotion activities, supply-demand connection activities to promote consumption abroad and domestically; support businesses to take advantage of and exploit free trade agreements of which Vietnam is a member.

At the same time, the Minister also emphasized the importance of promoting the campaign "Vietnamese people prioritize using Vietnamese goods" to exploit the domestic market with a potential of more than 100 million people, along with continuing to simplify administrative procedures, creating favorable conditions for businesses, authorizing the issuance of certificates of origin...

The Minister affirmed that building and developing brands is important, helping to improve competitiveness and develop the market for Vietnamese goods. Ministries, sectors, localities and enterprises have clearly recognized and coordinated to implement many solutions, in which the Ministry of Industry and Trade has implemented at three levels: Industry brands on a national scale; product brands with geographical indications, collective brands, and certified brands on a local scale; and product brands on an enterprise scale.

In the coming time, the Ministry will continue to implement brand development programs, focusing on raising awareness of the role, significance and necessity of building, developing and managing brands in production, business and investment.

In addition, the ministry will also organize training programs, provide advice and support on skills, techniques and issues to be noted in building and developing businesses; provide advice on innovation and design improvement to meet the tastes and requirements of domestic and foreign consumer markets; provide advice and support in registering trademarks and geographical indications for potential export products at home and abroad; develop and organize the implementation of propaganda and image promotion programs at home and abroad for each agricultural product and processed food.
