The Ministry of Education and Training has just issued a draft Circular guiding the functions, tasks and powers of the Department of Education and Training under the People's Committees of provinces and cities and the field of education and training of specialized departments under the People's Committees of communes and wards for comments.
The draft is designed to specify regulations on the division of authority of two-level local authorities in the field of state management ofeducation .
According to the draft, the rights and scope of management of the Department of Education and Training are greatly expanded compared to before.
Notably, the Department of Education and Training will be assigned to carry out all recruitment, management, use, reception, mobilization, secondment, transfer, appointment, promotion of professional titles, change of professional titles, training, fostering, and evaluation of teachers, management staff, civil servants, and employees in all public educational institutions under its management.

Previously, for preschool, primary and secondary schools, the recruitment and mobilization of teachers were carried out by the District People's Committee and the Department of Education and Training.
In addition, according to the draft Circular, the Department of Education and Training is assigned to advise the People's Committees of provinces and cities to perform tasks under the authority of the Minister of Education and Training, now decentralized to the Chairman of the People's Committee of the province.
That is the recognition of the province meeting the standards of universal education level 1 and level 2, and eliminating illiteracy level 1 for the province.
Permission to establish preschools and general education facilities by foreign diplomatic missions and intergovernmental international organizations.
Converting preschool and general education facilities proposed to be established by foreign diplomatic missions and intergovernmental international organizations into non-profit facilities.
Approval of joint organization of foreign language proficiency certification exams.
Granting, extending, amending and supplementing decides to enable the establishment of representative offices of foreign educational organizations and institutions in Vietnam.
Grant, amend, supplement, extend, re-grant, terminate operations, and revoke licenses to establish representative offices of foreign vocational education organizations and institutions in Vietnam.
The Ministry of Education and Training also plans to add two new tasks to the Chairman of the People's Committee at the communal level in performing state management tasks on education for educational institutions in the area.
Firstly, the Chairman of the People's Committee at the commune level decides to recognize, appoint, re-appoint, extend the working period to retirement age, dismiss, remove from office, second, change job positions, reward and discipline the heads and deputy heads of public educational institutions under their management.
Second, the Chairman of the People's Committee at the communal level decided to establish the school council; recognize, appoint, and dismiss the Chairman of the school council. At the same time, decide to recognize or not recognize the school council, the Chairman, Vice Chairman of the school council, principal, and vice principal at private educational institutions.
According to the Ministry of Education and Training, clearly defining the scope of consultation and the limits of authority at the commune level is a necessary step to perfect the decentralization mechanism in education management, contributing to improving the effectiveness and efficiency of policy implementation at the grassroots level.
