Early completion of the legal framework for the Law on Digital Technology Industry

DNO - On the morning of September 27, in Da Nang, the Committee for Science, Technology and Environment (National Assembly) held a workshop to collect comments on the draft Law on Digital Technology Industry in the Central provinces. Attending the workshop was Director of the Department of Information Technology and Communications Industry ( Ministry of Information and Communications ) Nguyen Khac Lich.

Mr. Nguyen Khac Lich said that Vietnam's digital technology industry revenue in the first 9 months of 2024 is estimated to reach 118 billion USD, an increase of 17.78% over the same period in 2023. Of which, revenue from software activities and digital industry services is 6.64 billion USD, an increase of 9.86% over the same period in 2023.

The Draft Law on Digital Technology Industry consists of 8 chapters and 73 articles regulating the digital technology industry, including: digital technology industry activities; digital technology industry development; rights and responsibilities of organizations and individuals participating in or related to the digital technology industry.

This Law does not regulate the production and provision of digital technology products and services for national defense, security, and cryptographic activities to protect state secret information.

The viewpoint of the Ministry of Information and Communications and the Drafting Committee of the Law on Digital Technology Industry is management and development, but more inclined towards development. He also explained the concerns of delegates about the scope of the law, in which digital technology includes information technology and new generation digital technologies.

The law is expected to stipulate that the production of digital technology products and the provision of digital technology services are industries and professions eligible for investment incentives according to the provisions of the law on investment and other relevant laws. Another breakthrough content of the draft Law on Digital Technology Industry is the mechanism for controlled testing of products and services converging digital technology.

In cases where there is no law regulating or different from the provisions of current law, the competent authority shall permit controlled testing in terms of space, time, scale, test subjects, rights and responsibilities of related subjects.

The Law is expected to provide for exemption from liability of the agency or person authorized to permit the testing and of the organizations or enterprises participating in the testing. Another new and strong point is that the Law focuses on human resource development.

Digital technology is a high-tech industry, so it requires high-quality human resources and the Law assigns the Government to issue regulations to create favorable conditions for living, working conditions... to attract talent.

At the workshop, delegates basically agreed on the necessity of developing and promulgating the Law on Digital Technology Industry and gave their opinions on: support and incentives for digital technology enterprises; controlled testing mechanism for digital technology convergence products and services; concept of digital assets; standards and techniques in the digital industry.

Deputy Director of the Department of Information and Communications of the city, Tran Ngoc Thach, said that the National Assembly's approval of Resolution No. 136/2024/QH15 dated June 26, 2024 on organizing the urban government model and piloting a number of specific mechanisms and policies for the development of Da Nang city is the basis for the city to build many preferential investment policies and attract investment in the fields of information technology, semiconductors and artificial intelligence in the coming time.

The implementation of Resolution No. 136/2024/QH15 will certainly have many points related to the Law on Digital Technology Industry, so it is hoped that the National Assembly will soon complete the legal framework as well as promulgate a Law with the consistency and synchronization of the draft law in the overall legal system.

Regarding the draft Law, Mr. Thach proposed that it is necessary to stipulate more policies to encourage foreign investors (FDI) and incentives for international cooperation. In addition, support for businesses needs to clearly stipulate incentives, if tax and land rent reductions are needed, at what level is appropriate.

In her concluding remarks, Standing Member of the Committee for Science, Technology and Environment Nguyen Thi Kim Anh said that the draft Law on Digital Technology Industry is a new draft law, expected to be submitted to the 15th National Assembly for comments at the 8th session and considered and approved at the 9th session.

The Law on Digital Technology Industry is built on the basis of selectively inheriting relevant provisions of the Law on Information Technology and documents guiding the implementation of the information technology industry, consistent with the current legal system on investment, finance, science and technology and synchronized with related law projects to ensure unity and synchronization in the legal system, facilitating implementation and application.

With a spirit of urgent and responsible work, the workshop completed the entire proposed program with many rich, in-depth and relatively comprehensive comments on the draft Law on Digital Technology Industry.

The opinions at the workshop will be fully studied and synthesized and sent to the National Assembly Standing Committee, the examining agency, and National Assembly deputies to practically serve the process of reviewing and giving opinions on the draft Law.
