Strengthening the management of construction materials quality

NDO - Currently, the construction materials industry is facing unfair competition from poor quality products, counterfeits and fakes. These products have penetrated the market and unfairly compete with Vietnamese construction materials products.

With this situation, the Ministry of Construction has just issued Circular 10/2024/TT-BXD dated November 1, 2024, effective from December 16, 2024, which will address key issues in the construction materials market, contributing to protecting consumer rights. Nhan Dan Newspaper reporter had an interview with the Director of the Department of Construction Materials ( Ministry of Construction ) Le Trung Thanh about this issue.

Reporter: Can you give a general assessment of the current development status of Vietnam's construction materials industry?

Mr. Le Trung Thanh: Vietnam's construction materials industry has a very strong production capacity. We have successfully exported many key construction materials products such as cement, tiles, sanitary ware, and construction glass to international markets. From 2014 to 2021, our construction materials products were consumed very well and achieved many successes. However, from 2022 to present, the construction materials industry, especially key products such as cement, tiles, sanitary ware, and glass, have encountered many difficulties in production and consumption. At the same time, the construction materials industry is currently facing unfair competition from poor quality products, counterfeit goods, and imitation goods. These products have penetrated the market and competed unfairly with Vietnamese construction materials, products that have been internationally recognized, met quality standards and regulations and exported to many countries around the world .

Recently, the Prime Minister chaired a national conference to remove difficulties and obstacles, promote sustainable production and consumption of construction materials. Implementing the Prime Minister's direction on strengthening the quality control of construction material products, the Ministry of Construction issued Circular 10/2024/TT-BXD, fully defining construction material products. Accordingly, products in group 2 must comply with regulations, while products in group 1 will be more strictly controlled. This Circular will strengthen the quality management of construction material products from the central to local levels, in order to ensure the quality of construction works and protect consumer rights as well as ensure that good quality products are consumed in accordance with regulations, while poor quality products, counterfeit goods, and imitation goods will be classified and handled.

Reporter: As a state management agency, can you assess the impact of Circular 10/2024/TT-BXD on the development of the construction materials industry and consumers?

Mr. Le Trung Thanh: In the past two years, the Ministry of Construction has received many comments from construction material associations such as the Vietnam Construction Ceramics Association, the Vietnam Glass and Glass Association, the Vietnam Cement Association, the Vietnam Concrete Association and other industry associations. The comments mainly revolve around the issue of unfair competition in the industry, especially the confusion between poor quality products.

For example, in the cement industry, some production facilities do not have sufficient capacity in terms of equipment and human resources but still put on the market products with names and labels similar to high-quality products, causing difficulties for consumers, contractors and investors when choosing products for their projects. In addition, there is a phenomenon of projects using imported products from abroad but the quality control is not good, causing difficulties in ensuring the quality of the project over time.

In this situation, Circular 10/2024/TT-BXD has proposed solutions to classify and group the quality of construction materials, ensuring that construction works and people's lives use safe and quality materials. In fact, key materials such as cement, tiles, sanitary porcelain, and construction glass, if not quality controlled, can cause damage to the construction industry.

Construction materials account for about 60-70% of construction costs, therefore, constructions using substandard materials may require repair and maintenance after a period of time, costing up to 10-15% of the construction value or up to 50% of the original material value.

After Circular 10/2024/TT-BXD is issued, consumers will benefit greatly in choosing quality products. At the same time, the Ministry of Science and Technology has also issued regulations on product traceability. Therefore, consumers can request businesses to provide certificates of conformity and information on the origin of the product. Consumers can also use product traceability tools such as QR codes to check product information before deciding to buy. Violators will be handled according to the law.

Reporter: There are opinions that the implementation deadline of Circular 10/2024/TT-BXD should be postponed so that businesses can prepare. What is your opinion?

Mr. Le Trung Thanh: The main purpose of Circular 10/2024/TT-BXD is to regulate the management of the quality of construction materials during operation, specifically: Production - Export - Import - Circulation on the market - Use to strengthen state management of the quality of construction materials products and goods, thereby screening good and poor quality products for management and handling of violations (if any); rectifying the production and trading of counterfeit, fake and poor quality goods that affect the quality of construction works and people's lives.

Currently, the opinions proposing to postpone the implementation of the Circular are mainly from enterprises importing construction materials, while enterprises producing, exporting, trading and using construction materials on the market do not propose to postpone the implementation of the Circular.

During the policy development process, the draft Circular was widely consulted with ministries, branches, localities, and construction material business associations; and posted for 60 days on the Ministry of Construction's Electronic Information Portal and the Government's Electronic Information Portal in accordance with regulations. The Ministry of Construction did not receive any comments on the application period of the Circular.

At the same time, 45 days before Circular 10/2024/TT-BXD takes effect (December 16, 2024), businesses can study and implement transitional provisions.

Specifically: “Article 20. Transitional provisions 1. For organizations and individuals producing and importing construction materials that have been granted a Certificate of Conformity in accordance with Technical Regulation QCVN16:2023/BXD and the Certificate is still valid, they are allowed to use the Certificate of Conformity and the conformity mark until the expiration of the Certificate. 2. For shipments of construction materials that have completed export procedures in exporting countries (for import into Vietnam) before the effective date of this Circular, the previous regulations shall apply.”

Thus, enterprises importing construction materials have enough time to use valid Certificates of Conformity or have enough time to complete export procedures for shipments before December 16, 2024, then transport goods to domestic border gates, even after a few months, they will still be subject to previous regulations.

Therefore, the proposal to postpone the implementation of the Circular is not well-founded. The timely implementation of Circular 10/2024/TT-BXD will help stabilize the construction materials market, help consumers choose better quality products and goods, and also quickly remove difficulties for enterprises producing and consuming construction materials.
