Building preferential policies and support for science and technology enterprises
The Ministry of Science and Technology said that the task of developing science and technology (S&T) enterprises has been affirmed as one of the key tasks in the S&T development strategy of the Party and the State. Through the development of the S&T enterprise system, it will help apply technology, scientific research results and technology development into production and business, create new products of high value, and improve production capacity by mastering technology.
On December 22, 2024, the Politburo issued Resolution No. 57-NQ/TW of the Politburo on breakthroughs in science, technology, innovation and national digital transformation. In particular, the Resolution sets out seven key tasks and solutions, emphasizing "strongly promoting science, technology and innovation activities and digital transformation in enterprises". Institutionalizing the Party's leadership, the Government has assigned the Ministry of Science and Technology to preside over the development of the Law on Science, Technology and Innovation to replace the Law on Science and Technology 2013. Along with that, the system of tax regulations is being studied for amendment in the Law on amending the Law on Corporate Income Tax. Policies to support enterprises on land and bidding are also being amended according to new documents.
Therefore, many provisions in Decree 13/2019/ND-CP are no longer suitable, have not promptly institutionalized the new guiding viewpoints of the Party and State and need to be replaced to be consistent and consistent with the legal system.
Limitations in the implementation of Decree 13/2019/ND-CP
According to the Ministry of Science and Technology, the number of science and technology enterprises granted certificates is still limited compared to the potential, basically only meeting 30% of the targets set in science and technology development strategies; among them, the number of science and technology enterprises formed from institutes, schools or converted from public science and technology organizations is very limited, accounting for a small proportion of science and technology enterprises granted certificates.
In addition, the number of science and technology enterprises enjoying preferential policies is limited. The database on science and technology enterprises is incomplete, lacking information, and has not been verified. Although the responsibility to report on performance results is one of the obligations prescribed for science and technology enterprises (the penalty for not reporting within 3 years is the revocation of the Science and Technology Enterprise Certificate), the number of enterprises complying with the reporting regime only accounts for 30%-40% of the total number of enterprises.
The state management system for science and technology enterprises has been established from the central to local (provincial) levels. However, apart from some large cities, in general, the requirements for the management system in the provinces have not yet met the requirements due to lack of attention from leaders, lack of staff, and inadequate capacity to implement policies. This is one of the main reasons why the policy for developing science and technology enterprises has not achieved results commensurate with its potential.
Simplify administrative procedures for certifying science and technology enterprises
The Ministry of Science and Technology said that the draft Decree replacing Decree No. 13/2019/ND-CP on science and technology enterprises ensures the full institutionalization of the guiding viewpoints in the Politburo's Resolutions on breakthroughs in science and technology development, innovation and digital transformation, and private economic development, in line with the socio-economic development situation, ensuring the constitutionality, legality, consistency and synchronization of the legal system, avoiding conflicts and overlaps in the management and implementation of regulations on science and technology enterprises.
At the same time, inheriting the provisions of Decree No. 13/2019/ND-CP on science and technology enterprises, the implementation of which does not cause any problems or difficulties for enterprises and state management agencies.
In addition, amend, supplement or replace specific provisions to overcome difficulties for businesses and state management agencies; review detailed provisions in Government Decrees and Circulars of guiding ministries for research and supplementation in the draft Decree for consistency and synchronization.
Develop incentive and support policies for science and technology enterprises that are highly feasible, non-overlapping and effective to support the formation and development of the science and technology enterprise system. Enhance the responsibility of agencies and organizations in implementing incentive and support policies for science and technology enterprises.
Review the subjects and conditions for certification of science and technology enterprises to suit the reality and increase the number of science and technology enterprises. Simplify administrative procedures related to certification of science and technology enterprises, ensuring convenience for online certification implementation.
