Continuing the 33rd Session, on the morning of May 14, the National Assembly Standing Committee gave opinions on the draft Law on Fire Prevention, Fire Fighting and Rescue.
Research and supplement regulations on fire prevention and fighting infrastructure planning
Presenting the report, Major General, Deputy Minister of Public Security Nguyen Van Long emphasized that the development and promulgation of the Law on Fire Prevention, Fire Fighting and Rescue is really necessary to continue institutionalizing the Party's viewpoints, guidelines and policies and strengthen leadership and management of this work.
The Party and State have also identified the development and promulgation of laws as important tasks and solutions to continue to improve and enhance the effectiveness and efficiency of implementing policies and laws on fire prevention and fighting, and have included them in the Law Development Program for the 15th National Assembly.
However, according to Deputy Minister Nguyen Van Long, it is necessary to fully stipulate in the draft law the contents of rescue activities for common incidents and accidents occurring in daily life that are being carried out by fire prevention, firefighting and rescue forces and have not yet reached the level of applying civil defense.
At the same time, research and supplement the draft law with regulations on organization, operation, scope of rescue, conditions for ensuring and responsibilities of agencies, organizations and individuals in this work; propaganda work, guidance on knowledge about rescue and other related issues to both comply with the provisions of the 2013 Constitution on ensuring human rights and civil rights, and create a transparent legal basis in determining and specifying the tasks that functional forces are allowed to perform and the limits, scope and methods of implementation in rescue and relief work.
Along with that, the reality of recent times has urgently required strengthening solutions, measures, and requirements to improve the effectiveness of state management of fire prevention and fighting. Amending and supplementing the provisions of the current law on fire prevention and fighting to promptly create a legal basis for effectively organizing the implementation of state management in this field in practice.
Accordingly, the draft law consists of 9 chapters and 65 articles.
Presenting the review report, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi proposed that, based on the Party's policy, the Drafting Agency should combine summarizing practices and researching and supplementing regulations on fire prevention and fighting infrastructure planning in the draft Law to stipulate specific contents and requirements for fire prevention and fighting infrastructure planning and the relationship with national sectoral planning, regional planning, and provincial planning.
Regarding fire prevention activities, there are suggestions to continue studying and clarifying fire prevention and fighting requirements for each type of planning to have appropriate solutions and designs; carefully assess the impact of regulations on fire prevention and fighting safety conditions for houses, motor vehicles and facilities; study regulations on fire prevention and fighting requirements and conditions suitable for each type of facility, especially the type of housing combined with production and business; study and clearly stipulate the level of construction work that changes its function or is renovated, and motor vehicles that are converted must have appropriate fire prevention and fighting solutions and designs...
Some opinions proposed separate regulations on fire prevention and fighting forces and rescue forces; research and rearrange the organization and operation of civil defense forces to be consistent with the Party's policies and guidelines, ensuring consistency with the Law on Forces participating in protecting security and order at the grassroots level and ensuring the effectiveness of fire prevention and fighting and rescue activities.
Feasible innovation, linked to socio-economic life
Discussing at the meeting, delegates basically agreed on the necessity of promulgating the Law on Fire Prevention, Fire Fighting and Rescue.
The development and promulgation of laws aims to fully institutionalize the Party's policies and guidelines on this field; legalize current regulations and supplement full and comprehensive regulations on rescue activities that the fire prevention, fighting and rescue forces are undertaking, creating a solid legal basis to improve the effectiveness of this work in practice.
According to Chairwoman of the National Assembly's Judicial Committee Le Thi Nga, the development and promulgation of the law contributes to overcoming shortcomings and difficulties in practice; ensuring the consistency and unity of legal policies on this work; improving the effectiveness of state management, inspection and examination of fire prevention and fighting; promoting the socialization of fire prevention and fighting work, creating policies to attract agencies, organizations and individuals to participate in research and technology transfer for production and assembly of equipment.
However, regarding the regulation: "In case of fire in a village or residential group, the village chief or residential group leader is the person in charge of fire fighting; in case these people are absent, the civil defense team leader or authorized person is the person in charge of fire fighting", Ms. Le Thi Nga said that it is "not appropriate"; she proposed to add the head of household or a member of the household as the person in charge of fire fighting in the village or residential group in case the village chief, residential group leader or civil defense team leader is absent.
Emphasizing the need to ensure unity and synchronization in the legal system, Chairman of the National Assembly's Economic Committee Vu Hong Thanh cited regulations that when adjusting general and detailed planning for urban areas, residential areas, industrial clusters, and functional areas, it must comply with the provisions of the law on planning and have design solutions for fire prevention and fighting.
"This is a very necessary regulation because in the past, when fires broke out in residential areas with small access roads, fire prevention and fighting equipment could not be brought in. However, technically, the Law on Planning does not have any regulations on this issue, but the draft Law refers to legal regulations on planning, which cannot be implemented. Therefore, it is necessary to design separate regulations on this issue," said the Chairman of the Economic Committee.
Regarding the regulations on inspection and acceptance of fire prevention and fighting, Mr. Vu Hong Thanh said that the draft law is assigning many state management agencies to implement but there is no assignment or coordination between these units.
"With such regulations, people and businesses must go to many places to submit procedures. To reduce conditions and procedures in investment and business, regulations on fire prevention and fighting inspection and acceptance need to be designed appropriately to ensure convenience for people and businesses," said Mr. Vu Hong Thanh.
Highly appreciating the preparation of the Drafting Agency and the Review Agency, Politburo member and Permanent Vice Chairman of the National Assembly Tran Thanh Man said: “This is a very important draft law, affecting the socio-economy, the lives of people and businesses, associated with ensuring social order and safety, protecting lives and property, so it needs to be studied, reviewed carefully and urgently to overcome shortcomings and limitations, and at the same time have appropriate and feasible innovations associated with socio-economic life”.
The Standing Vice Chairman of the National Assembly requested to learn from practical limitations to minimize the number of fires and damage to people and property in the future.
The continuous occurrence of fires and accidents such as the fires in Ho Chi Minh City, Hanoi... in recent times has directly affected the lives and properties of society, and is also a 'valuable' lesson in this work.

The Standing Vice Chairman of the National Assembly requested the Drafting Agency to carefully assess and review the scope of rescue work and incidents between sectors to clarify responsibilities; specify the coordination, command and support mechanisms involved; suggest that regulations on fire prevention and fighting planning must be placed within the overall scope of the law; further study and expand standards and regulations on fire prevention, fighting and rescue, especially regulations of a specific nature...
