This is the content that has attracted much attention in the inspection conclusion announcement just announced by the Government Inspectorate on the responsibility of the Gia Lai Provincial People's Committee in managing and using land, land originating from agricultural and forestry farms... from January 1, 2016 to December 31, 2020.
The Government Inspectorate pointed out that the People's Committee of Gia Lai province has been lax in land use management and investment supervision, allowing violations to occur, typically:
Granting investment policies while investors do not ensure financial capacity; exempting land rent in violation of regulations; having projects built on forestry land that has not been converted to land use purposes (Yang Trung Power Plant, Cho Long Power Plant);
Applying incorrect methods to determine specific land prices; not recovering deposits as prescribed for projects behind schedule; issuing land use right certificates when the investor has not signed a land lease contract and has not fulfilled financial obligations; determining m3 coefficients and land use fees that are not guaranteed according to regulations (New Residential Area Project invested by Saigon Garment - Match Joint Stock Company; Hotel and Commercial Townhouse Complex Project at 29 Nguyen Van Cu Street).
During the inspection process, the Government Inspectorate also pointed out that the Gia Lai Provincial People's Committee did not rearrange public land and houses to organize auctions according to Decision No. 09/2007/QD-TTg dated January 19, 2007 of the Prime Minister, leading to the risk of losing state budget revenue from land rent exemption and reduction (Hoang Dieu Asean High School Construction Investment Project);
In addition, when approving the bidding documents, setting criteria that were too high compared to the scale of the project limited the participation of other investors, not ensuring competition, fairness, and transparency (Pleiku City Hotel and Commercial Townhouse Complex Project invested by FLC Company);
Gia Lai province also let a business owe land rent for many years (Duc Long Gia Lai Group Joint Stock Company - Duc Long Gia Lai Group) but did not resolutely handle it.
As Lao Dong reported in early August 2024, Duc Long Gia Lai Group has just officially filed a lawsuit with the People's Court of Quang Ngai City, Quang Ngai Province regarding Lilama 45.3 Joint Stock Company's filing of a request to open bankruptcy proceedings against this group.
On February 8, 2023, the Gia Lai Provincial People's Court of Appeal issued a judgment on the dispute over the performance of a contract for the supply, manufacture and installation of hydraulic mechanical equipment between Lilama 45.3 Joint Stock Company (Quang Ngai City, Quang Ngai Province) and Duc Long Gia Lai Group.
The court ruled that Duc Long Gia Lai Group must pay Lilama 45.3 Joint Stock Company more than 17 billion VND. Of which, the principal debt is 14.7 billion VND and the late payment interest is 2.3 billion VND.
In July 2023, Lilama 45.3 Joint Stock Company submitted a request to open bankruptcy proceedings against Duc Long Gia Lai Group and was approved by the Provincial People's Court, which notified the acceptance of the application.
However, Duc Long Gia Lai Group appealed, and the High People's Court in Da Nang overturned the decision of the Gia Lai Provincial People's Court, affirming that the enterprise was not unable to pay its debts.
Duc Long Gia Lai Group believes that Lilama 45.3 Joint Stock Company's filing of a lawsuit and the competent authority's notification of acceptance of the lawsuit has damaged the company's brand and reputation.
Because when the decision to open bankruptcy proceedings was made and the information spread, the stock price and the psychology of shareholders of Duc Long Gia Lai Group were immediately affected.
