Site clearance is considered a key factor, deciding the progress of the Provincial Road 394B Construction Investment Project, the section connecting Provincial Road 395 to the North-South axis, Thanh Mien.

Removing the "bottleneck" of land clearance

Provincial Road 394B Construction Investment Project (section connecting Provincial Road 395 to the North-South axis, Thanh Mien) is 6.84 km long. The scale of the level II plain road, design speed 80 km/h, is divided into two sections with cross-sections of 25m and 37m. The project has a total investment of more than 1,208 billion VND, with the West Hai Phong Construction Investment Project Management Board as the investor. The route is intended to synchronize with the sections being implemented of Provincial Road 394B. This is an important traffic project that helps connect National Highway 5 with the Hanoi - Hai Phong Expressway, the North-South axis, Thanh Mien, the East-West axis, gradually completing the traffic infrastructure, while creating conditions to attract investment in industrial, urban and service projects.

Immediately after the groundbreaking ceremony in May 2025, contractors focused on implementing 4 roadbed construction projects and 1 highway overpass construction project. However, the project's progress is currently affected by problems in site clearance and scarce material resources.

According to the Binh Giang Area Construction Investment Project Management Board, the total land area to be recovered to implement the Provincial Road 394B Construction Project (the section connecting Provincial Road 395 to the North-South axis, Thanh Mien) is more than 348,356 m2 , spanning 4 communes. Of which, Duong An commune will recover 95,096.9 m², Binh Giang commune 109,823 m², Ke Sat commune 14,317 m², and Nguyen Luong Bang commune 129,120 m². This is a very large volume of land clearance, requiring synchronous coordination from localities and high consensus from the people to ensure project progress.

By the end of 2024, Binh Giang district (old) - where the project passes through, has completed basic site clearance for agricultural land. Currently, the project site clearance work still has some difficulties and problems in Duong An commune. 12 households have agricultural land mixed with rice land, aquaculture land and perennial trees that have not been counted; the residential land area of 44 households has not been identified and assets on the land have not been counted.

In Binh Giang commune, some households with converted land, the area adjusted up or down after review have not yet had a compensation plan established because the origin of land use has not been clarified, and the residential land area has not been counted. Ke Sat commune still has 4 households with agricultural land and is counting households with residential land, however, some households have not signed to confirm the volume. Nguyen Luong Bang commune still has more than 24,500 m² of rice land of 80 households that have not been counted, along with the area of land for traffic works and cemeteries that have not been counted.

The cause of the difficulty is that some land areas have been approved for compensation but must be adjusted due to re-determining the boundaries, causing additional procedures, specific land prices have not been determined, many areas have complicated legal documents, many areas have unclear origins of use...

Determination from the grassroots

Comrade Nguyen Ngoc Quan, Permanent Vice Chairman of Duong An Commune People's Committee, said that immediately after receiving the task of clearing the land for the Provincial Road 394B project, the Commune People's Committee established the Land Clearance Council, then established the Land Origin Determination Council and the Land Valuation Council from the beginning of July 2025. These three councils operate simultaneously to shorten the time, ensuring that the steps of counting, verifying the origin and determining compensation are carried out synchronously.

Duong An Commune has developed a disbursement scenario and a site clearance scenario that closely follows the construction progress, aiming to hand over the entire cleared site to the contractor by December 2025. In the immediate future, the locality will focus on handling agricultural land, and it is expected that in August 2025, the compensation plan will be approved and the site will be handed over to the contractor. For 40 households with residential land and assets on the land that must be resettled, the commune has surveyed and agreed on the location of the resettlement area in Luoc Vac area, old Thai Minh commune with about 50 plots of land, ensuring sufficient demand. It is expected that in November - December 2025, the compensation plan will be approved and the site of the residential land will be handed over to the construction unit.

During the implementation process, the main difficulties were complicated land records, unclear land use origins, and many households did not agree on compensation plans. To resolve the problem, Duong An commune considered site clearance for key projects a key political task, mobilizing the entire political system to participate. The government increased direct dialogue with the people, explained legal policies, and listened to and promptly adjusted related problems.

Mr. Dao Dinh Hoang, Deputy Director of the Binh Giang Area Investment and Construction Project Management Board, said that when implementing the two-level local government, the board received the dossier from the old Binh Giang District Liberation Council and in July handed over the land clearance dossier to the communes where the 394B Road project passes through. Up to this point, the communes have established the Land Clearance Council. The communes of Ke Sat and Binh Giang conducted land and property inventory on residential land areas.

According to the plan this week, the Binh Giang Regional Investment and Construction Project Management Board will count assets in Duong An Commune and complete the inventory records in Nguyen Luong Bang Commune. The Regional Board will strengthen coordination with localities to speed up the progress of compensation and site clearance.
