Automatic extension of inspection cycle for vehicles with less than 9 seats that are not used for transportation business

composed, passenger cars with up to 9 seats that are not used for transportation business (with a production period of up to 7 years and a production period of 13 - 20 years) that have been granted a Certificate and Inspection Stamp before March 22, 2023 and are still valid for inspection as of June 3, 2023 will have their inspection cycle automatically extended according to the new cycle prescribed in Circular 02/2023/TT-BGTVT.

The inspection agency will automatically issue a Certificate of Validity of the Certificate and Inspection Stamp for the above vehicles without the vehicle owner having to bring the vehicle to the inspection center for re-inspection.

According to calculations, more than 1.9 million cars with up to 9 seats that are not used for transportation business have their inspection deadline postponed for another 6 months.

The Circular also clearly states that automatic extension of the inspection cycle does not apply to cases where the Inspection Certificate and Inspection Stamp expire before the effective date of this Circular.

Therefore, vehicles that are due for inspection before June 3rd must still go to vehicle inspection centers to be granted a Certificate and Inspection Stamp. There are approximately 156 thousand vehicles in this category.

Priority is given to vehicles that have expired but have not been inspected.

The Vietnam Register said that after the Circular was issued, the unit urgently held an online meeting with registration centers nationally to guide the implementation of Circular 08/2023.

For vehicles that are eligible for the above certificate, if they do not have the information and still come to the inspection center on June 3, 2023, they will be guided to the website of the Vietnam Register to view and print the Certificate without having to bring the vehicle to the inspection line.

The Vietnam Register also requires inspection centers to prioritize inspection of vehicles that have expired but have not been inspected, vehicles that have had an inspection appointment, and commercial vehicles so that people can soon have vehicles that ensure technical safety and environmental protection to participate in traffic, and transport businesses can soon put their vehicles into operation, minimizing unnecessary damage to society.

According to Circular 02/2023/TT-BGTVT, passenger vehicles with less than 9 seats that are not used for transportation business and are manufactured up to 7 years ago are exempt from registration for 36 months (previously 30 months), the periodic inspection cycle is 24 months (an increase of 6 months compared to before); vehicles manufactured from 7 to 20 years ago (previously 12 years ago) have a periodic inspection cycle of 12 months; vehicles over 20 years old have a cycle of 6 months.

Prevent inspection centers from rejecting vehicles exempted from inspection for the first time

The new Circular of the Ministry of Transport also clearly stipulates: Exemption from first inspection is when the inspection unit bases on the Factory Quality Inspection Certificate or the Certificate of Technical Safety and Environmental Protection for Imported Motor Vehicles or the Notice of Exemption from Technical Safety and Environmental Protection for Imported Motor Vehicles and related documents as prescribed in this Circular to establish vehicle records, manage, store according to regulations and issue Inspection Certificates and Inspection Stamps without having to inspect and evaluate the vehicle.

At the same time, update data with the content "vehicle has performed the first inspection exemption" to the inspection management program of the Vietnam Register.

If the motor vehicle has been issued a Certificate and a first inspection stamp, the issuance of the Inspection Certificate and Inspection Stamp will be refused.

In case the motor vehicle only has an Appointment Paper for Vehicle Registration, the inspection unit shall issue the First Inspection Stamp and at the same time issue an Appointment Paper for Return of Inspection Certificate to the vehicle owner according to the prescribed form.

When the vehicle owner presents the Vehicle Registration Documents (Original Vehicle Registration Certificate issued by a competent state agency or original Receipt of holding the original Vehicle Registration Certificate (with a copy of the vehicle registration certificate) mortgaged by a credit institution or Copy of the vehicle registration certificate certified by a financial leasing organization), the inspection unit will photocopy this type of document to keep in the vehicle file, inspection file and return the Inspection Certificate.

The above specific regulations according to the Vietnam Register aim to clearly assign responsibilities to the inspection center, ending the situation of refusal to perform services for vehicles exempted from first-time inspection as reported by the press.

In addition, the Circular also clearly stipulates that for motor vehicles with yellow license plates, black letters and numbers, and license plate series using one of the letters A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z, a Certificate of Inspection and Inspection Stamp for motor vehicles used for transportation business will be issued.

In other cases, the Inspection Certificate and Inspection Stamp are issued according to the vehicle owner's declaration.

According to the Department of Motor Vehicle Inspection, clarifying this regulation aims to remove obstacles in the implementation of the issuance of Inspection Stamps for semi-trailers because this is a means of transport business but according to the provisions of Circular No. 58/2020/TT-BCA, it is not required to have a yellow plate. The above specific regulations are for inspection centers to uniformly issue Inspection Stamps for semi-trailers in accordance with the regulations of the Ministry of Public Security .

Regarding the form of receiving registration for inspection, the Circular adds regulations that the inspection unit receives registration through one of the following forms: directly, by phone, on the website, or via the online registration application for motor vehicles when the vehicle owner has a need.

For vehicles that fail the first inspection, the inspection unit must warn on the inspection management program about the vehicle's defects and damage so that other inspection units can carefully inspect the vehicle when re-inspecting it a second time, helping to increase the effectiveness of vehicle inspection, improve vehicle quality as well as the responsibility of the vehicle owner.

In case a motor vehicle is re-inspected on the same working day at the same inspection unit, the inspection unit will only re-inspect the items that failed.

Particularly for items related to the brake system or steering system, if any item fails, all items of the corresponding brake system or steering system must be re-checked.

In case of re-inspection on another day or at another unit, all items must be re-inspected./.
