The Prime Minister directed the removal of obstacles in the management and use of land, land allocation, and land valuation.

A telegram sent to the ministers of the Ministries of Natural Resources and Environment, Agriculture and Rural Development, Planning and Investment, Finance, Construction, Justice, Information and Communications; the Inspector General of the Government ; and the chairmen of the People's Committees of provinces and centrally-administered cities stated: In the past, the Government and the Prime Minister have issued numerous directives to ministries, sectors, and localities to urgently address difficulties and obstacles in land management and use, land valuation, issuance of land use rights certificates, ownership certificates for houses and assets attached to land, and simplification of administrative procedures in the land sector. However, based on direct feedback from citizens, businesses, the press, and discussions with localities, the implementation of the Government and Prime Minister's directives has been slow and not sufficiently decisive.

In order to promptly resolve difficulties and obstacles, unlock and utilize land resources, promote the implementation of socio-economic development projects, alleviate difficulties in the real estate market, and ensure the legitimate rights and interests of people and businesses, the Prime Minister requests:

1. The Minister of Natural Resources and Environment urgently needs to:

a) Listen to, study, and incorporate the opinions of localities, organizations, associations, businesses, and individuals participating in the process of finalizing the draft amended Land Law, so that the provisions of the amended Land Law, when promulgated, will be effective; the regulations must be clear, transparent, easy to understand, easy to implement, easy to monitor and inspect; strengthen decentralization and delegation of power in land allocation, land leasing, and land use conversion; strengthen the personal responsibility of heads of departments, while promoting inspection and supervision, resolutely avoiding causing inconvenience to people and businesses, and meeting the requirements of reality.

b) Before October 25, 2023, submit to the Government for consideration and promulgation a decree amending and supplementing Decree No. 44/2014/ND-CP dated May 15, 2014, in a scientific and practical manner, simplifying procedures, minimizing intermediate steps, clearly defining regulations that are easy to understand and convenient for implementation, and preventing losses to the state budget when determining land prices, preventing corruption and negative practices, and eliminating fear of making mistakes, taking responsibility, or hesitating to act.

c) Before October 31, 2023, submit to the Prime Minister a study on adjusting the national land use planning targets for the period 2021-2030, with a vision to 2050, and the national 5-year land use plan 2021-2025, which have been allocated to localities in Decision No. 326/QD-TTg dated March 9, 2022, to meet the land use needs of localities for implementing socio-economic development projects and works, unlocking resources, and restoring the economy in the coming period.

d) Instruct localities to implement the issuance of land use rights certificates, house ownership certificates, and certificates for assets attached to land, following the principle of simplifying procedures and avoiding causing inconvenience or harassment to citizens and businesses during the process.

e) Develop plans for specialized inspections and unscheduled inspections within their jurisdiction to prevent, deter, and rectify violations related to land in ministries, sectors, and localities.

2. Chairpersons of the People's Committees of provinces and centrally-administered cities:

a) Focus on directing land valuation work and determining land prices within the scope of authority, in accordance with the Government's directive in Resolution No. 73/NQ-CP dated May 6, 2023, without causing difficulties, delays, or affecting the progress of investment project implementation, in order to unlock resources and promote socio-economic development.

b) Direct the provincial Department of Natural Resources and Environment to expedite and properly implement administrative procedures for granting land use rights certificates, house ownership certificates, and certificates for ownership of assets attached to land, and for changing land use purposes for organizations and individuals; rectify discipline, order, and public service ethics of officials and civil servants in the process of implementing and resolving administrative procedures related to land.

c) Review and evaluate the results of implementing the land use targets allocated to the province by the Prime Minister; propose land use needs that ensure efficient and economical exploitation and use of land in accordance with regulations; and avoid wasting land resources.

3. The Ministers of Agriculture and Rural Development, Justice, Finance, Construction, Planning and Investment, Information and Communications, the Government Inspectorate, and other relevant ministries and agencies shall proactively coordinate closely with the Ministry of Natural Resources and Environment to promptly guide localities in resolving difficulties and obstacles related to land management and use, land valuation, and the issuance of land use right certificates, house ownership certificates, and certificates of ownership of assets attached to land, in accordance with their assigned functions, authority, and current regulations.

4. Assign Deputy Prime Minister Tran Hong Ha to directly supervise the ministers and chairmen of the People's Committees of provinces and centrally-administered cities, who are responsible to the Prime Minister for organizing, implementing, monitoring, inspecting, and promptly addressing the difficulties faced by citizens and businesses as reflected and proposed by the provinces and centrally-administered cities in accordance with this directive.

5. The Government Office shall monitor, advise, and urge relevant ministries, agencies, and localities to effectively implement this directive, and promptly report to the Prime Minister any obstacles or difficulties encountered during the implementation process.
