On the morning of May 14, Prime Minister Pham Minh Chinh chaired a meeting with ministries, branches and central agencies to assess the work of combating smuggling, trade fraud, counterfeit goods, intellectual property violations, and goods origin in the first months of 2025 and the directions and tasks for the coming time.
Attending the conference were: Deputy Prime Minister, Head of National Steering Committee 389 Bui Thanh Son; leaders of ministries, branches, central agencies; members of National Steering Committee 389.
According to reports and opinions at the meeting , in the first months of 2025, units and localities have stepped up the fight against smuggling, trade fraud, and counterfeit goods, arresting and handling more than 34,000 violations. Of which, there were more than 8,200 cases of trading and transporting prohibited and smuggled goods; more than 25,100 cases of trade fraud and tax fraud; more than 1,100 cases of counterfeit goods and intellectual property violations; collected more than VND 4,897 billion for the State budget; prosecuted nearly 1,400 cases and more than 2,100 subjects.
In the coming time, ministries, branches and agencies will continue to thoroughly grasp and strictly implement the directives of the Government, the Prime Minister and the National Steering Committee 389 on the fight against smuggling, trade fraud and counterfeit goods.
Develop programs, plans, and solutions to combat smuggling, trade fraud, and counterfeit goods in accordance with local conditions and task requirements; especially focus on combating and effectively preventing illegal drug trafficking and transportation, smuggling, illegal transportation of gold, foreign currency, and counterfeit goods of Vietnamese origin for export to other countries; and production and trade of counterfeit goods, poor quality goods, and goods that infringe intellectual property rights.
Ministries and branches, according to their functions, review legal documents and regulations related to the fight against counterfeit and poor quality goods, promptly propose amendments and supplements to regulations to overcome limitations and shortcomings, create a legal corridor to improve the effectiveness of the fight against smuggling, trade fraud and counterfeit goods.
Authorities promote digital transformation and apply information technology in the fight against smuggling, trade fraud and counterfeit goods; enhance connectivity, information sharing and provision; deploy and improve the effectiveness of hotlines, ensuring timely collection and handling of reports from the public.
Strengthen inspection and supervision of ministries and branches on the work of combating smuggling, trade fraud and counterfeit goods and the forces performing the tasks. Attach responsibility to the Party committees, heads of agencies and organizations in the work of combating smuggling, trade fraud and counterfeit goods; promptly detect and strictly handle individuals who assist, protect and cover up smuggling, trade fraud and counterfeit goods activities.
Strengthen the National Steering Committee 389 and the Steering Committees 389 of ministries, branches and localities; amend decisions and regulations regulating the operations of the Steering Committees 389 at all levels to improve the effectiveness of the fight against smuggling, trade fraud and counterfeit goods; proactively establish interdisciplinary teams to inspect and supervise the compliance with legal regulations of enterprises, organizations and individuals to promptly detect and handle subjects with acts of smuggling, trade fraud and counterfeit goods.

Prevent, repel and eventually end
In his concluding remarks, Prime Minister Pham Minh Chinh stated that in recent times, the authorities have made great efforts, focused on leading and directing the fight against smuggling, trade fraud, counterfeit goods, intellectual property violations, and violations of goods origin; the work that has been done is very commendable.
However, the situation of smuggling, trade fraud, counterfeit goods, intellectual property violations, and violations of goods origin is still complicated, widespread, involving many subjects, and complex in nature, greatly affecting socio-economic development, health, people, and the country's reputation and brand, affecting trust and causing confusion and anxiety among the people.
The reasons are that the leadership, direction, and advisory work of some ministries, branches, and localities have not been truly thorough, drastic, specific, timely, and effective, and have not yet focused on complex developments, issues, and newly emerging issues; the management of some agencies is lax; some regulations are outdated, not promptly amended and supplemented to meet the situation; the organization and implementation work is still limited, functions and tasks are still overlapping and missing; and the strength of the entire people has not been mobilized.
In addition, the awareness of a part of the people has not fully understood the violations due to limited and incomplete information, communication and guidance work; the handling of violations has not been timely and thorough; coordination between agencies is sometimes not tight; e-commerce activities are developing rapidly but management has not kept up with the situation... Some individuals participating in the prevention work have committed violations, such as the authorities have just prosecuted and temporarily detained the former Director of the Department of Food Safety (Ministry of Health)...
Assessing that the situation will continue to be complicated in the coming time and may become more complicated; the Prime Minister clearly stated the goal of fighting, preventing, repelling and eventually ending smuggling, trade fraud, production and circulation of counterfeit goods, fake goods, goods of unknown origin, copyright infringement, intellectual property infringement and goods origin infringement.
From there, protect the legitimate and legal rights and interests of people and businesses, improve the material and spiritual life of people, contribute to the rapid and sustainable development of the country, promote growth, consolidate macroeconomic stability, protect security, safety and security of the people, contribute to improving national competitiveness, prestige and brand of the country, build an independent and self-reliant economy associated with active and proactive international integration, deeply, substantially and effectively.

Regarding viewpoints, the Prime Minister stated that this is an important task for the entire political system, Party committees and authorities must get involved, strengthen state management at all levels and sectors, and mobilize the participation of the people; it is a long-term task that must be done regularly, comprehensively, and continuously.
The Prime Minister emphasized that protecting the health, rights and legitimate interests of the people and consumers must be put first and foremost. Increasing the effectiveness of the work of preventing smuggling, trade fraud, production and circulation of counterfeit goods, fake goods, goods of unknown origin, copyright infringement, intellectual property infringement, and goods origin must be closely linked to the process of arranging administrative boundaries at all levels, organizing two-level local governments, streamlining the apparatus, improving management capacity and defining responsibilities of agencies, ensuring no overlap or omission.
Affirming that this is an issue of great concern to the people, affecting their health and interests, the Prime Minister emphasized the need to create a breakthrough in preventing smuggling, trade fraud, production and circulation of counterfeit goods, fake goods, goods of unknown origin, copyright infringement, intellectual property infringement, and goods origin. Ministries, branches and localities must focus on leadership, direction, proactively build and perfect institutions, mechanisms, policies, organize implementation, closely coordinate, strengthen inspection, supervision, handle violations and attach importance to emulation and timely, appropriate, objective and fair rewards.

Prevent false 'cure-all' advertisements
Assigning tasks to ministries and branches, the Prime Minister directed the Ministry of Home Affairs to review the functions and tasks of ministries and branches, not to leave legal gaps, and not to loosen management because of organizational arrangements, apparatus, and administrative boundaries.
The Ministry of Public Security directed professional forces and local police to establish special projects and strictly handle violators; coordinate with prosecution agencies to speed up the investigation, prosecution, and trial of cases, promptly publicize the results on mass media for deterrence and prevention... On this occasion, the Prime Minister commended the police force for its efforts, closely following the situation, implementing professional work, and clearly stated that the tasks of the police force in the coming time will be very heavy in this work.
The Ministry of Finance directs customs and tax forces to facilitate businesses while ensuring the prevention of violations within their functions, tasks and powers.
The Ministry of Industry and Trade shall coordinate with the People's Committees of provinces and cities to direct market management forces to handle violations; complete e-commerce policies; preside over and coordinate with relevant agencies to review legal documents; issue and amend circulars under the authority of ministries and branches; if under the authority of the Government, submit amendments and supplements to decrees and resolutions; develop and amend relevant laws to submit to the National Assembly in a shortened form as soon as possible.
The Ministry of Industry and Trade leads and directs the market management force, which is primarily responsible for, presides over, and coordinates with agencies to inspect the compliance with the law by organizations and individuals in the production and trading of goods and commercial services. Specialized inspection agencies under ministries, branches, and localities are responsible for licensing and management by field and area, paying special attention to items such as medicines, milk, food, etc.
Along with that, specify the tasks of the People's Committee at the commune level in coordinating with departments, branches, and management units to inspect and supervise production facilities in the area; develop the Law on E-commerce, amend the Law on Commerce, amend the Decree on the origin of goods, and decrees related to import and export. Strengthen the market management force in the locality. Research and propose the main responsible agencies in case of violations in the area.

The Ministry of Science and Technology urgently reviews, amends and supplements regulations related to intellectual property, adjusts newly arising issues, especially in the digital environment and e-commerce; strengthens inspection and handling of organizations and individuals who violate and publish false products.
The Ministry of Health urgently carries out tasks, especially controlling the import of counterfeit drugs and smuggled drugs of unknown origin into Vietnam, playing a key role, resolutely fighting and repelling, ending the situation of counterfeit drugs, considering the care and protection of people's health as the top priority.
The Ministry of Health, the Ministry of Agriculture and Environment, and the Ministry of Industry and Trade coordinate with relevant agencies to strengthen post-inspection and strictly handle violations, especially fake food and fake medicines of unknown origin; perfect regulations on post-inspection and licensing of goods, with the spirit of being able to control but ensuring transparency, actively applying digital transformation, building databases; develop the Food Safety Law, amend outdated decrees and circulars, strengthen sanctions, promote the self-awareness of relevant entities and enhance the people's response.
The Ministry of Agriculture and Environment shall strengthen inspection, supervision, and strictly handle violations of forestry products, aquatic products, plant and animal breeds, fertilizers, and pesticides; and strengthen control over the use of stimulants and chemicals. At the same time, it shall strengthen branding, planning, and development of raw material areas, and expand the market for agricultural products and food.
The Ministry of Culture, Sports and Tourism is studying additional sanctions to deal with those who take advantage of their reputation to advertise falsely, especially on the internet; and working with relevant agencies to prevent false advertisements of the "panacea" type.
The Ministry of Justice coordinates with ministries and branches to promote, supplement and perfect institutions to manage and promote production and business development.

The People's Committees of provinces and cities direct market management forces to strictly handle violations in their localities; pay attention to socio-economic development, especially in remote areas and border areas; work with border guards and police to strengthen strict management at the border, ensure social order and safety, control and prevent smuggling, counterfeit goods and fake goods across the border.
Media agencies, VTV, VOV, VNA, press agencies, and functional forces should increase propaganda and mobilization on this work, explain the harmful effects of violations, and mobilize people's strength; at the same time, review and control advertising activities.
The Prime Minister also requested to launch an emulation movement to fight against smuggling, trade fraud, production and circulation of counterfeit goods, counterfeit goods, copyright and intellectual property infringement; at the same time, it was noted that agencies need to have high determination, great efforts, drastic and effective actions, with focus and key points, and clearly assign 6 tasks: "Clear people, clear work, clear time, clear responsibility, clear authority, clear products" in this work.
