Standards for the positions of Director, Deputy Director, and equivalent positions according to the new government regulations.

The government has just issued Decree No. 29/2024/ND-CP stipulating the standards for leadership and management positions of civil servants.

PROFESSIONAL, POLITICAL, PUBLIC ADMINISTRATION, AND FOREIGN LANGUAGE STANDARDS

The government clearly stipulates the standards applicable to leadership and management at all levels; including the standards for the positions of Director, Deputy Director of departments and equivalent positions.

Accordingly, the positions of Director, Deputy Director of a department, and equivalent positions must meet the general standards applicable to leadership and management positions in terms of political ideology; ethics, lifestyle, and organizational discipline.

In terms of professional qualifications, the above positions require a university degree or higher in a field relevant to the job as stipulated by the competent authority.

In terms of political theory, those holding the position of director of a department and equivalent positions, including: Director of a department, Chief of the Office of the National Assembly and People's Council Delegation, Chief of the Office of the Provincial People's Committee, Chief Inspector of the province, Head of the Ethnic Affairs Committee, must have a Bachelor's degree in Political Science or Advanced Political Theory or Advanced Political Theory - Administration, or a certificate of equivalent Advanced Political Theory level from a competent authority.

Deputy Directors of Departments, Deputy Chiefs of the Office of the National Assembly and People's Council Delegation, Deputy Chiefs of the Provincial People's Committee Office, Deputy Chiefs of the Provincial Inspectorate, and Deputy Heads of the Ethnic Affairs Committee must possess a diploma in Intermediate-level Political Theory or higher, or a certificate of equivalent Intermediate-level Political Theory issued by a competent authority.

Regarding state management, directors of departments and equivalent positions need to have a certificate of training in knowledge and skills in state management for civil servants in the senior specialist and equivalent ranks.

Individuals holding the position of Deputy Director of a department or equivalent must possess a certificate of training in state management knowledge and skills for civil servants at the senior specialist level or higher.

Regarding foreign language proficiency, Decree 29/2024 clearly states: “Possess foreign language proficiency appropriate to the leadership and management position as prescribed by the ministry, sector, or locality where the position is held, or be able to use a minority ethnic language in cases where the position directly involves ethnic minorities or the position is held in an ethnic minority area. The determination of foreign language proficiency and cases where diplomas or certificates are deemed equivalent shall be carried out in accordance with the law.”

In addition to general standards, Decree 29/2024 also requires meeting specific standards regarding competence and reputation; health, age, and work experience.

In particular, regarding the regulations on practical experience and appropriate length of service, Decree 29/2024 clearly stipulates:

For appointments from within the existing personnel pool: If the agency or organization where the candidate is currently working has a constituent unit: The candidate must have previously held a leadership or management position within that constituent unit; the time spent in the current position or a position immediately preceding the proposed appointment must be at least 2 years (24 months). If not continuous, the time spent in the position or equivalent position can be added together (only the time spent in the position or equivalent position can be added together).

In cases where the agency or organization where the employee is currently working does not have constituent units: Ensure continuous employment in the relevant industry or field corresponding to each specific position or title as prescribed.

For personnel appointments from external sources: If the agency or organization where the employee is currently working does not have a constituent unit: Ensure continuous service time in the relevant industry or field corresponding to each specific position or title as prescribed;

In cases where the current workplace has a constituent unit and the prospective appointee does not have one: Ensure that the time spent in the immediately preceding equivalent position or title to the prospective position or title is also at least 2 years (24 months).

In cases where the current employing agency or organization has a constituent unit and the planned appointment is made within that agency or organization: Ensure that the tenure in the immediately preceding equivalent position or title is at least 2 years (24 months), or ensure continuous service in the relevant industry or field corresponding to each specific position or title as prescribed.

SPECIFIC STANDARDS

In addition to meeting the general standards mentioned above, Decree 29 stipulates specific standards for each job title.

Accordingly, the Director of a Department and equivalent positions are the heads of departments, leading, managing, and organizing the implementation of state management functions and tasks in their respective sectors and fields within the province or centrally-administered city, and performing other tasks assigned by competent authorities; they are directly responsible to the Provincial People's Committee and the Chairman of the Provincial People's Committee, and are also responsible for state management of their sector and field to the Minister of the relevant ministry and to the law regarding their assigned responsibilities and duties.

In addition to meeting general standards, department directors and equivalents must meet the following requirements:

In-depth understanding of state administration, knowledge of laws related to the industry and field of management, and specific regulations applicable at the local level;

Competent in: Advising and directing the effective implementation of central government legal documents; advising on the development of legal documents applicable to the local sector/field; directing the development of term-based and annual work plans for the local sector/field; directing or directly resolving difficult and complex issues within the local sector/field; implementing administrative reforms, civil service regulations, and civil servant policies in the area; directing the implementation of inspections, audits, and handling according to the law; directing the resolution of petitions, complaints, and denunciations from organizations and citizens within its jurisdiction; advising leaders on coordinating with central government agencies; directing the synchronized, unified, and effective implementation of the Party's guidelines, policies, and laws throughout the province.

Currently holding the position of Deputy Director of a department or equivalent position or title as prescribed by the competent authority according to the hierarchical management of cadres.

Deputy Directors and equivalents are subordinates of the Director, assisting the Director in managing and organizing the implementation of one or more areas of work within the functions and duties of the department, and are responsible to the Director and to the law for the assigned responsibilities and duties.

In addition to meeting general standards, Deputy Directors of Departments and equivalent positions must meet the following requirements:

In-depth understanding of state administration, knowledge of laws related to the industry and field of management, and specific regulations applicable at the local level;

Competent in: Advising on the effective implementation of central government legal documents; advising on the development of legal documents applicable to the local sector/field; directing the development of term-based and annual work plans for the local sector/field; directing or directly resolving difficult and complex issues within the local sector/field; directing the implementation of inspections, audits, and handling according to the law; directing the resolution of petitions, complaints, and denunciations from organizations and citizens within its jurisdiction; advising leaders on coordinating with central government agencies; directing the synchronized, unified, and effective implementation of the Party's guidelines, policies, and laws throughout the province.

Currently holding the position of Head of Department or equivalent within the agency, or an equivalent position or title as prescribed by the competent authority according to the personnel management hierarchy. If not holding a position, must have at least 7 years of continuous work experience in the industry or field (excluding probationary or trial periods).
