Dispute over the name of the contest 'Miss Peace', the Copyright Office speaks up

Recently, the companies Sen Vang and Minh Khang have continuously asserted their ownership of the name of the Miss Grand Vietnam contest.

Regarding this issue, Ms. Pham Thi Kim Oanh, Deputy Director of the Copyright Department, affirmed: The Department has granted copyright to the works of the two units Sen Vang and Minh Khang "in accordance with legal procedures".

Ms. Pham Thi Kim Oanh, Deputy Director of the Copyright Department, informed about the dispute over the name of the Miss contest between the two units Sen Vang and Minh Khang.

"In 2022, the Department received the registration dossier and granted a Copyright Certificate to Minh Khang Company for the work of writing the script for the Miss Grand Vietnam 2023 contest according to the procedure for submitting the dossier to the competent state agency and committed to take responsibility before the law.

Meanwhile, Sen Vang Company submitted documents to register two works, and we granted a Copyright Certificate for the Miss Grand Vietnam-Miss Grand Vietnam beauty contest script on April 8, 2022, and the Miss Grand Vietnam-Miss Grand Vietnam logo application art work on May 10," said Ms. Kim Oanh.

The Deputy Director of the Copyright Department added: "After we granted the certificate to Sen Vang Company and were organizing the review and asking for opinions from relevant agencies to organize the contests according to the regulations of the Department of Performing Arts, Minh Khang Company requested to change the name. It was no longer the script for the Miss Peace Vietnam 2023 contest but the script for the Miss Peace Vietnam contest. At that time, Sen Vang Company issued a document along with the document of the international organization related to copyright issues. Therefore, we stopped the re-issuance of Minh Khang Company."

Explaining the suspension of this renewal, Ms. Oanh said that in 2022, Vietnam will become a member of the WIPO Treaty of the World Intellectual Property Organization on copyright. Therefore, it is required to comply with all regulations and international treaties on the basis of the initial documents provided as prescribed in Article 49 of the Law on Intellectual Property, which stipulates: Copyright registration, registration of related rights.

Faced with the current situation of disputes over the names of beauty contests, a representative of the Copyright Office said: "Although the names of works are not an independent subject protected under Article 14 of the Law on Intellectual Property, in recent times, there have been cases where some individuals and organizations have taken advantage of this to affect the rights and legitimate interests of other individuals and organizations."

Ms. Kim Oanh said that in order to promptly prevent this situation: "In the draft decree detailing and implementing measures for a number of articles of the Law on Intellectual Property on copyright and related rights, which is being submitted to competent authorities for the Government to promulgate and implement the law, there is an additional provision on the naming of works. That is, the provision that naming a work must not violate Clause 2, Article 7 of the Law on Intellectual Property and other relevant laws."

According to the representative of the Copyright Office, this is a content added to tighten the provisions of the law to limit disputes similar to the case of the name of the Miss Grand Vietnam contest.

In 2022, two companies, Sen Vang and Minh Khang, continuously asserted their ownership of the name of the Miss Grand Vietnam contest. Sen Vang holds the copyright of the Miss Grand International contest, commonly known by its Vietnamese name, Miss Peace. Meanwhile, Minh Khang is the company that created the Miss Peace Vietnam contest, the literal translation of the contest's Vietnamese name is Miss Grand Vietnam.

Because they have the same Vietnamese name, both companies want to be the sole owners of this name. Both Minh Khang and Sen Vang have spent a lot of time preparing legal evidence to prove their ownership.
