Avoid requesting land for infrastructure without a proper plan.

(Dan Tri Newspaper) - Representative Hoang Van Cuong believes that it is necessary to clearly specify the progress of planning implementation, and to implement infrastructure planning first, before urban planning.
On the morning of October 25th, the National Assembly discussed in the plenary session several contentious issues in the draft Law on Urban and Rural Planning. Regarding the issue of prioritizing infrastructure planning over urban planning, Representative Hoang Van Cuong ( Hanoi ) argued that for centrally-governed cities, in addition to provincial planning, a general plan is necessary because each plan has different functions. However, representatives also pointed out that these two types of plans have overlapped in the past, so a clear distinction must be made in this law. According to Mr. Cuong, the overlap stems from the fact that previously there was no provincial planning, only general planning with the function of guiding development for all sectors and fields. Subsequently, there were detailed plans for each sector and field.

He argued that currently, provincial-level plans function as development guidelines, but there are no longer plans for specific sectors and fields. Therefore, the current general plan must concretize and guide the provincial plan, replacing the sectoral plans that are currently absent. He proposed amending Article 20 of the draft law to specify the contents regarding the development of infrastructure elements. Areas without zoning plans must have clearly defined boundaries for demarcation. Areas with zoning plans must have clearly defined locations for the zoning plan to establish boundary markers; and amending Article 34 of the draft law to consolidate technical infrastructure plans (ground elevation, drainage, transportation, irrigation, etc.) to ensure consistency across the general plan and avoid overlaps. The delegates also suggested that in Article 50, Clause 3 of the plan for implementing the planning, the progress of implementing the plans should be clearly specified, prioritizing infrastructure planning before urban planning to avoid the current situation where land is requested for infrastructure development before the plan is in place. This would prevent overlapping tasks and shirking responsibility. Speaking before the National Assembly, delegate Ly Tiet Hanh (Binh Dinh) stated that urban and rural planning is closely related to many other types of planning, linked to specific investment projects, therefore this draft law involves many different specialized laws.

Regarding responsibility for organizing and preparing urban and rural planning tasks, she suggested that there should be a unified principle regarding the lead agency in organizing and preparing planning tasks, zoning plans, and detailed area plans for land use rights auctions or investor selection tenders when assigned by provincial and district People's Committees. According to her, thorough research is needed to ensure uniformity across the entire system, avoiding overlapping tasks, shirking responsibility, or different assignment methods in each locality, leading to inconsistencies and difficulties in implementation. Regarding the same issue, Representative La Thanh Tan (Hai Phong) argued that the draft law needs provisions to ensure the compliance of construction investment projects with urban and rural planning in cases of conflict between plans… According to the representative, the current provisions in the draft law could lead to a situation where, when a project encounters inconsistencies between plans, it must be halted to await a decision from the competent authority on the implementation plan or to wait for adjustments to the plans to ensure consistency. Furthermore, Article 8 of the draft law only addresses conflicts between urban and rural planning as stipulated in this law. "In reality, there are still conflicts and overlaps between construction plans and many other plans such as mineral, energy, transportation, agriculture , and land use plans that have not yet been addressed," Mr. Tan stated. Mr. Tan suggested that the drafting agency should research and add principles for applying and using planning when there are conflicts between plans, in order to have a basis for quick identification and application, avoiding waste of time, costs, and opportunities for investors and state resources.
