In Decree No. 140/2025/ND-CP dated June 12, 2025, which stipulates the delineation of authority between two levels of local governments in the field of state management under the Ministry of Construction , the Government specifically defines the tasks and authority regarding construction permits.
According to the Decree, the authority to issue construction permits as stipulated in the 2014 Construction Law (amended and supplemented in 2020) is exercised by the People's Committee at the commune level. In addition, the authority to approve construction sites has also been transferred to the People's Committee at the commune level.

From July 1st, commune-level People's Committees are authorized to issue construction permits.

The procedures and related contents concerning construction permits and site approvals shall be implemented in accordance with the provisions of the 2014 Construction Law (amended and supplemented in 2020) and Decree No. 175/2024/ND-CP.
The People's Committee at the commune level is also authorized to collect environmental protection fees for emissions, establish an Asset Valuation Council chaired by the Chairman of the People's Committee at the commune level, and has the authority to organize and implement price stabilization measures within the local area.
According to Decree No. 140/2025/ND-CP, commune-level authorities are authorized to receive and review applications for purchasing, renting, or lease-purchasing social housing; and to verify income and housing conditions. Furthermore, commune-level authorities coordinate the verification of information recorded in land ownership certificates, publicly disclose project information, and supervise and organize the forced recovery of houses (if necessary).
The People's Council at the commune level can also decide on preferential loan capital for social housing development from the local budget, the Housing Development Fund, or other legal sources.
