
Minister of Justice Le Thanh Long, acting on behalf of the Prime Minister, has signed a report to the National Assembly on judicial assistance activities in 2023.
Signed numerous bilateral agreements on mutual legal assistance.
According to the report, in 2023, the Government and the Prime Minister continued to direct the Ministry of Justice, the Ministry of Foreign Affairs, the Ministry of Public Security, and requested the Supreme People's Court and the Supreme People's Procuratorate to closely coordinate to comprehensively implement key tasks in all four areas of judicial assistance: civil, criminal, extradition, and transfer of persons serving prison sentences.
In the field of mutual legal assistance in criminal matters, the Chief Prosecutor of the Supreme People's Procuratorate, in coordination with various ministries and agencies, successfully negotiated three bilateral agreements.
In addition, acting on the authorization of the President , the Chief Prosecutor of the Supreme People's Procuracy signed five bilateral agreements.
In the field of extradition and transfer of prisoners serving sentences, the Ministry of Public Security, in coordination with other ministries and agencies, successfully negotiated 10 bilateral agreements.
Acting on behalf of the President, the Minister of Public Security signed 7 bilateral agreements (3 extradition agreements with Argentina, Iran, Italy, the United Arab Emirates, and Laos; 4 agreements on the transfer of prisoners serving sentences with Argentina, Iran, Italy, and Kazakhstan). In addition, 3 other agreements have concluded negotiations.
Regarding the implementation of judicial assistance requests, the Minister of Justice stated that in 2023, Vietnam sent 2,385 requests for civil judicial assistance abroad, receiving 1,830 results. Foreign countries sent 1,033 requests for judicial assistance to Vietnam, receiving 1,231 results.
Compared to 2022, the number of judicial assistance requests from Vietnam to foreign countries increased by 245, while the number of judicial assistance requests from foreign countries to Vietnam decreased by 29. The number of judicial assistance results received in both directions increased by 184 and 148 respectively.
In criminal matters, Vietnam sent 377 requests for judicial assistance abroad, receiving 217 results. Foreign countries sent 89 requests to Vietnam, receiving 72 results.
Thus, the number of criminal justice requests from Vietnam sent abroad this year increased by 42.8% compared to 2022 (264 requests). Similarly, the number of requests that received responses was also higher (206 results in 2022).
The number of judicial assistance requests from foreign countries sent to Vietnam decreased, but the resolution rate increased by 12%.
Send 40 transfer requests from overseas to Vietnam.
Regarding extradition requests, data from the Ministry of Public Security shows that in 2023, Vietnam sent 13 extradition requests to foreign countries. The Ministry of Public Security is currently continuing discussions with its partners to complete and supplement the required documents.
In addition, the Ministry of Public Security, in coordination with relevant agencies, organized the handover of two individuals requested for extradition to the Russian Federation.
Vietnam has also received 4 requests to transfer prisoners serving sentences from Vietnam to abroad and sent 40 requests for transfer from abroad to Vietnam.
According to the minister, requests for the transfer of prisoners serving sentences from Vietnam to foreign countries are being processed in accordance with the law (verification of nationality, relevant information, etc.). The Ministry of Public Security has forwarded one case to the competent court for consideration.
Regarding cases of transfer from Vietnam to foreign countries, the Ministry of Public Security has referred two cases to the competent courts, while discussions with foreign parties are ongoing for the remaining two cases.
The police also coordinated with relevant authorities to transfer three prisoners (one South Korean national and two Australian nationals) back to their home countries to continue serving their prison sentences.
To overcome limitations and shortcomings, the Government stated that it will direct and propose the completion of proposals for the Law on Mutual Legal Assistance in Civil Matters, the Law on Mutual Legal Assistance in Criminal Matters, the Law on Extradition, and the Law on Transfer of Persons Serving Prison Sentences.
At the same time, it will be included in the 2025 legislative and ordinance drafting program, and preparations will be made for drafting subsequent laws after they are included in the program.
