Vietnam sends 13 extradition requests to foreign countries

Minister of Justice Le Thanh Long has just signed, on behalf of the Prime Minister, a report to the National Assembly on judicial assistance activities in 2023.

Signed many bilateral agreements on judicial assistance

According to the report, in 2023, the Government and the Prime Minister will continue to direct the Ministry of Justice, the Ministry of Foreign Affairs, the Ministry of Public Security and request the Supreme People's Court and the Supreme People's Procuracy to closely coordinate to comprehensively implement key tasks in all four areas of judicial assistance: civil, criminal, extradition and transfer of prisoners.

In the field of judicial assistance in criminal matters, the Chief Justice of the Supreme People's Procuracy presided over and coordinated with ministries and branches to successfully negotiate three bilateral agreements.

Along with that, implementing the authorization ofthe President , the Chief Justice of the Supreme People's Procuracy signed 5 bilateral agreements.

In the field of extradition and transfer of prisoners, the Ministry of Public Security presided over and coordinated with ministries and branches to successfully negotiate 10 bilateral agreements.

Under the authorization of the President, the Minister of Public Security signed 7 bilateral agreements (3 extradition agreements with Argentina, Iran, Italy, the United Arab Emirates, and Laos; 4 agreements on the transfer of prisoners with Argentina, Iran, Italy, and Kazakhstan). In addition, 3 agreements have concluded negotiations.

Regarding the implementation of judicial delegations, the Minister of Justice said that in 2023, Vietnam sent 2,385 civil judicial delegations abroad and received 1,830 results. Foreign countries sent 1,033 judicial delegations to Vietnam and received 1,231 results.

Compared to 2022, Vietnam's judicial commissions sent to foreign countries increased by 245 files, while foreign judicial commissions sent to Vietnam decreased by 29 files. The number of judicial commission results received in both directions increased by 184 and 148 files, respectively.

Regarding criminal matters, the number of judicial commissions sent by Vietnam to foreign countries was 377, receiving 217 results. The number of foreign requests sent to Vietnam was 89, receiving 72 results.

Thus, the number of criminal judicial commissions sent by Vietnam abroad this year increased by 42.8% compared to 2022 (264 requests). Similarly, the number of requests with responses is also higher (206 results in 2022).

The number of foreign judicial commissions sent to Vietnam decreased but the settlement rate increased by 12%.

Send 40 transfer requests from abroad to Vietnam

Regarding the implementation of extradition requests, data from the Ministry of Public Security shows that in 2023, Vietnam sent 13 extradition requests to foreign countries. Currently, the Ministry of Public Security is continuing to discuss with partners to complete and supplement the dossier as requested.

In addition, the Ministry of Public Security has coordinated with relevant agencies to organize the handover of two subjects requested for extradition to the Russian Federation.

Vietnam has also received four requests to transfer prisoners from Vietnam to foreign countries and sent 40 requests to transfer from foreign countries to Vietnam.

According to the minister, requests to transfer prisoners from Vietnam to foreign countries are being processed in accordance with the law (verifying nationality, relevant information, etc.). The Ministry of Public Security has transferred one case to a competent court for consideration.

Regarding cases of transfer from Vietnam to foreign countries, the Ministry of Public Security has transferred 2 cases to competent courts, and the remaining 2 cases are continuing to be discussed with foreign parties.

The police also coordinated with relevant agencies to transfer 3 prisoners (1 Korean prisoner, 2 Australian prisoners) back to Vietnam to continue serving their prison sentences.

To overcome limitations and shortcomings, the Government said it will direct and propose to complete the proposal to build the Law on Mutual Legal Assistance in Civil Matters, the Law on Mutual Legal Assistance in Criminal Matters, the Law on Extradition, and the Law on Transfer of Persons Serving Prison Sentences.

At the same time, include it in the 2025 law and ordinance making program and prepare to develop draft laws after being included in the program.

In addition, promote research activities, propose signing bilateral international treaties... ./.
