Regarding the case involving approximately 1,000 people who purchased land in projects in Dien Ban town ( Quang Nam province), customers are demanding clarification of the province's responsibility in signing Decision No. 2450.
Recently, more than 50 people, representing 1,000 customers involved in a brokerage contract dispute between Bach Dat An Joint Stock Company (Bach Dat An Company, the investor) and Hoang Nhat Nam Investment Joint Stock Company (Hoang Nhat Nam Company, the broker), held a dialogue.
The dialogue focused on options to ensure the rights of these customers are protected after a long period of delay by the developer, who failed to fulfill their financial obligations to the state and implement the project to issue land titles to the residents.

Mr. Nguyen Dinh Nam, a customer who purchased land plots at the Hera Complex Riverside urban area project, asked the representative of the brokerage firm: "If the government revokes the project, has Hoang Nhat Nam Company already developed a compensation plan? If a criminal case is initiated against Bach Dat An Company, how will the rights of the people be protected? Will the previous court rulings be affected?"
Many customers also believe that if Bach Dat An Company still fails to implement the project, criminal proceedings and project revocation will occur, and the legitimate rights of the people must be addressed according to the court's ruling. Mr. Truong Van Hao, General Director of Hoang Nhat Nam Company, said: "Over the past period, Hoang Nhat Nam has repeatedly offered to fulfill Bach Dat An's obligations to expedite the issuance of land titles to the people, but to no avail. No one else but the investor is responsible for implementing the project. If the final solution is to initiate criminal proceedings and revoke the project, this is a decision of the competent authorities."
Most customers are requesting that authorities clarify the responsibility of the Quang Nam Provincial People's Committee when signing Decision No. 2450/QD-UBND allowing the transfer of the investor role for 14 projects in the province from Bach Dat Production and Trading Co., Ltd. to Bach Dat An Company. These include three projects: the 7B Expanded Urban Area, the Hera Complex Riverside Urban Area, and the Bach Dat Urban Area.
According to Mr. Tran Kim Luyen, a customer who purchased real estate in the Bach Dat 1 Urban Area project, the Quang Nam Provincial People's Committee approved the transfer of the investor role for 14 projects in the province from Bach Dat Production and Trading Co., Ltd. to Bach Dat An Company without complying with legal regulations on bidding, land, investment, and enterprises.
Specifically, at the time of the transfer of ownership from Bach Dat Production and Trading Co., Ltd. to Bach Dat An Company, these two companies were two independent legal entities, not a parent company and subsidiary company as defined by corporate law.
Furthermore, Bach Dat An Company took over the investor role from Bach Dat Production and Trading Co., Ltd. for 14 projects in Quang Nam province, while the latter's charter capital was only 20 billion VND. This customer stated that they will submit a retroactive petition to the National Assembly, the Government, and the Ministry of Justice regarding the issuance of Decision No. 2450 by the People's Committee of Quang Nam province. The case of "breaching" real estate brokerage contracts between Bach Dat An Company and Hoang Nhat Nam Company concerning three real estate projects: Bach Dat Urban Area, Expanded Urban Area No. 7B, and Hera Complex Riverside Urban Area (part of the Dien Nam - Dien Ngoc New Urban Area, Dien Ban town, Quang Nam province) is unprecedented in Central Vietnam. The case involves approximately 1,000 customers and has lasted from 2017 to the present.
People's courts at all levels have ruled, requiring the investor, along with the authorities and brokers, to continue the contract, implement the project, and issue land titles to the people, but to date, the case has not seen any positive progress. The case, which has dragged on for many years, has significantly affected security and order as well as investment activities in the locality, with hundreds of customers, who have related rights and obligations, continuously gathering in large numbers to demand their rights.
