The case of 1,000 red books debt: Customers are worried, asking questions about the province's documents

Regarding the case of about 1,000 people buying land at projects in Dien Ban town ( Quang Nam ), customers requested to clarify the province's responsibility when signing Decision No. 2450.

Recently, more than 50 people, representing 1,000 customers involved in the brokerage contract dispute between Bach Dat An Joint Stock Company (Bach Dat An Company, investor) and Hoang Nhat Nam Investment Joint Stock Company (Hoang Nhat Nam Company, broker) had a dialogue.

The dialogue content is about solutions to ensure the rights of these customers after a long period of investors procrastinating, not fulfilling financial obligations to the state and implementing the project to issue certificates to the people.

Mr. Nguyen Dinh Nam - a customer who bought land at the Hera Complex Riverside Urban Area project asked the representative of the brokerage unit: "If the government revokes the project, does Hoang Nhat Nam Company have a compensation plan? If a criminal case is initiated against Bach Dat An Company, how will the rights of the people be guaranteed? Will the previous court verdicts be affected?"

Many customers also believe that when Bach Dat An Company still does not implement the project, the criminal prosecution and project revocation will take place, and the legitimate rights of the people must be resolved according to the court's verdict. Mr. Truong Van Hao, General Director of Hoang Nhat Nam Company, said: "In the past, Hoang Nhat Nam has proposed many times to replace Bach Dat An's obligations to soon issue certificates to the people but was not successful, to implement the project is none other than the investor. If the final solution is to prosecute the case and revoke the project, this is the decision of the authorities.

Most customers requested that the authorities clarify the responsibility of the People's Committee of Quang Nam province when signing Decision No. 2450/QD-UBND allowing the transfer of the investor role of 14 projects in the province from Bach Dat Production and Trading Company Limited to Bach Dat An Company. Including 3 projects: 7B Urban Area Expansion, Hera Complex Riverside Urban Area, Bach Dat Urban Area.

According to Mr. Tran Kim Luyen - a customer who bought real estate at Bach Dat 1 Urban Area project, the People's Committee of Quang Nam province approved the transfer of the investor role of 14 projects in the province from Bach Dat Production and Trading Company Limited to Bach Dat An Company without complying with the provisions of the law on bidding, land, investment, enterprises...

In particular, at the time of transferring the investor from Bach Dat Production and Trading Company Limited to Bach Dat An Company, these two companies were two independent legal entities, not parent companies or subsidiaries according to the provisions of enterprise law.

Furthermore, Bach Dat An Company received the transfer of the investor role from Bach Dat Production and Trading Company Limited of 14 projects in Quang Nam province while the charter capital of this company is only 20 billion VND. This customer said that he will send a retroactive petition to the National Assembly, the Government, and the Ministry of Justice regarding the issuance of Decision No. 2450 of the People's Committee of Quang Nam province. The case of "breaking the contract" of real estate brokerage between Bach Dat An Company and Hoang Nhat Nam Company for 3 real estate projects: Bach Dat Urban Area, Urban Area No. 7B expansion, Hera Complex Riverside Urban Area (in Dien Nam - Dien Ngoc New Urban Area, Dien Ban town, Quang Nam province) is an unprecedented case in the Central region. The case involves about 1,000 customers, lasting from 2017 to present.

The People's Courts at all levels have issued judgments, requiring the investor, the government and brokers to continue the contract, implement the project and issue certificates to the people, but so far the case has not had any positive changes. The case has lasted for many years, causing significant impacts on the security and order situation as well as investment activities in the locality when hundreds of customers with related rights and obligations continuously gather in large numbers to demand their rights.
