According to the Ministry of Natural Resources and Environment , the 2024 Land Law and the decrees detailing and guiding the implementation of the Law have added many regulations requiring organizations and individuals to manage and use land economically and effectively; some violations, forms and levels of penalties are no longer suitable and need to be amended and supplemented to suit the actual situation and ensure feasibility.
Regarding the regulations on administrative sanctions for violations in the land sector, although certain results have been achieved in preventing violations, there are still some shortcomings such as: The level of sanctions is still light, not ensuring deterrence; due to the complicated history of land management and use, many violations that occurred in the past have not been detected and handled, especially violations that occurred before October 15, 1993 are very difficult to determine, the statute of limitations for sanctions has expired; some remedial measures are not suitable for reality. According to Decree No. 91/ND-CP dated November 19, 2019 of the Government, some concepts, terms, and specific violations are still unclear and difficult to determine in practice, leading to difficulties in applying sanctions for violations in the land sector...
Therefore, the issuance of a Decree regulating administrative sanctions for violations in the land sector is necessary to meet practical requirements in the current period. The draft Decree regulating administrative sanctions for violations in the land sector consists of 04 Chapters and 36 Articles, of which 04 Chapters remain unchanged and 08 Articles are reduced compared to Decree No. 91/ND-CP.
At the conference, delegates discussed and contributed many opinions to the draft Decree, especially the contents related to regulations on decentralization, authority to sanction administrative violations of land at the grassroots level, inspection of land violations, handling of violations of land allocation, land lease, transfer of land use rights, encroachment, improper use, etc.
Speaking at the conference, the Deputy Prime Minister emphasized that the handling of administrative violations in the land sector is an important issue that needs to be carefully studied and receive comments from ministries, branches and localities. He requested ministries, branches and localities to continue studying the draft Decree, contributing comments based on difficulties, shortcomings and problems from practice to complete the draft, helping the Decree when issued to ensure feasibility and effectiveness in the management and handling of violations in the land sector. Based on the comments, the Ministry of Natural Resources and Environment will absorb and complete the draft and submit it to the Government for consideration and promulgation of the Decree in the coming time.
