Mr. Nguyen Ha's family ( Thanh Hoa ) has a piece of land, most of which was granted a Land Use Rights Certificate in 2007, while the remaining part of the land the family is still using has not been granted a Certificate, with documents proving that it belongs to the family.
Mr. Ha asked, what procedures do he need to do to request the authorities to re-determine the family's land area, including the part that has not been granted a Certificate, as a basis for re-issuing the Land Use Rights Certificate?
In response to this issue, the Ministry of Agriculture and Environment said that Mr. Ha's reflection is a specific case under the jurisdiction of the locality and needs to be based on archived records and specific regulations issued by the locality under its authority to implement the Land Law for consideration and resolution; therefore, the Ministry has no basis to respond. The Ministry would like to state some principles as follows:
Current land law has specifically regulated the issuance of Certificates of land use rights and ownership of assets attached to land for the first time to households and individuals using land in Articles 137, 138, 139 and 140 of the Land Law.
The Government has fully regulated the components of the submitted dossier, the order and procedures for implementation in Decree No. 101/2024/ND-CP dated July 29, 2024 and Decree No. 151/2025/ND-CP dated June 12, 2025.
At the same time, the Minister of Agriculture and Environment issued Decisions: No. 2304/QD-BNNMT dated June 23, 2024, No. 3380/QD-BNNMT dated August 25, 2025 promulgating administrative procedures in the land sector under the state management functions of the Ministry of Agriculture and Environment.
Accordingly, specific land procedures are prescribed, including the following steps:
- Implementation sequence;
- How to do it;
- Components and number of documents;
- Processing time;
- Subjects performing administrative procedures;
- Administrative procedure performing agency;
- Results of administrative procedure implementation;
- Fees;
- Name of form, declaration;
- Requirements and conditions for performing administrative procedures (if any);
- Legal basis of administrative procedures.
