The report on the Law on Artificial Intelligence project presented by Minister of Science and Technology Nguyen Manh Hung said that the development and promulgation of the Law project aims to institutionalize the Party and State's policies, creating a breakthrough legal corridor for artificial intelligence. Creating a favorable legal environment to promote innovation, enhance national competitiveness; manage risks, protect national interests, human rights and digital sovereignty.
The draft Law consists of 8 Chapters and 36 Articles, regulating the promotion of research, development, provision, deployment and use of artificial intelligence systems; rights and obligations of relevant organizations and individuals; and state management of artificial intelligence activities in Vietnam.

The Draft Law does not apply to artificial intelligence systems developed, provided, deployed, and used exclusively for defense, security, intelligence, and cryptographic purposes. Artificial intelligence systems or artificial intelligence models developed, provided, deployed, and used only within the internal scope of research, training, and scientific development facilities and have not been put into operation or provided to third parties...
The draft Law also stipulates the risk level of artificial intelligence systems; classification and notification of artificial intelligence systems; responsibility for transparency, labeling and accountability; responsibility for managing and handling artificial intelligence incidents; and artificial intelligence systems with unacceptable risks.

Promote integration and mutual recognition of technology
The report on the review of the Law project presented by Chairman of the Committee on Science, Technology and Environment Nguyen Thanh Hai stated that the Committee agreed with the necessity of promulgating the Law on Artificial Intelligence to supplement and perfect the existing legal framework, establish a more unified, synchronous, comprehensive and flexible management mechanism, suitable to the characteristics of the field of artificial intelligence; promote integration and mutual recognition of technology. Thereby, enhancing Vietnam's position in the global value chain and expanding international cooperation in the field of artificial intelligence.

The Committee found that the draft Basic Law closely followed the Party's guidelines and policies and the State's policies on science and technology development, innovation and national digital transformation.
At the same time, it is recommended that the drafting agency continue to review and evaluate more carefully the level of institutionalization of the Party's policies and orientations, especially on the development of artificial intelligence for humans and sustainable development. Through the examination of the National Assembly's agencies, it is shown that some regulations are not yet consistent with the legal system, such as the classification of the risk level of artificial intelligence systems into 4 levels. While the Law on Product and Goods Quality classifies products and goods into 3 types, it is not consistent if artificial intelligence is considered a product or goods. Regulations on certification of conformity for artificial intelligence systems with high risk levels are not consistent with the principles of management of products and goods with high risk levels stipulated in Point d, Clause 4, Article 5 of the Law on Product and Goods Quality...

The Committee finds that the scope of regulation in the draft Law is relatively comprehensive, reflecting a comprehensive approach, but has not clarified the boundaries between the fields regulated by this Law and related laws such as the Law on Science, Technology and Innovation; Law on Data; Law on Digital Technology Industry, etc.
The new draft Law focuses on research, development and application of artificial intelligence systems but does not fully cover other intermediary entities and factors; it does not regulate internal training, research, development and testing of artificial intelligence.
The Committee recommends that it is necessary to study and complete regulations on the scope of regulation to avoid overlap with current laws; study, expand the scope of regulation and supplement regulations related to the above-mentioned intermediary entities to ensure comprehensive management of the artificial intelligence value chain and prevent risks arising from the provision of platforms and original models.

Consider adding internal training, research, development, and testing as high-risk AI systems, even in an internal environment, can cause serious technical or cybersecurity incidents if left unchecked…
