Focus on investing in application and testing
Clause 1, Article 12 of the Draft Law on High Technology (amended) stipulates 3 types of research and development of high technology and strategic technology, including: research on creating new strategic technology; research on mastering and improving technology; research on applying and testing strategic technology. However, Point b, Clause 1, Article 14 only stipulates that the State encourages and creates conditions to "increase investment in research and development activities to innovate high-tech products and strategic technology products" .

According to the delegate, in reality, the application and testing of the above products need a lot of investment attention. Therefore, it is proposed to add incentives for “application and testing” along with incentives for “innovation” and rewrite it as: “increase investment in research and development activities to innovate, apply and test high-tech products and strategic technology products” to meet practical needs, ensuring consistency with the regulatory framework in Clause 1, Article 12 above.
Along with that, Article 15 of the draft Law stipulates a number of regulations on high-tech enterprises, strategic technology enterprises and preferential and support policies for these two types of enterprises. Delegates proposed to consider and supplement the provisions, whether the above two types of enterprises are considered a type of science and technology enterprise (at a higher level); if so, is it necessary to register operations with both types of enterprises? Are the preferential policies for the types of enterprises stipulated in Article 15 different from the preferential policies for science and technology enterprises?
"The drafting agency is requested to review related laws to ensure consistency and specificity of preferential policies for each type of enterprise," the delegate emphasized.
Agree to add regulations on high-tech urban areas
In Article 18, promoting the transfer and commercialization of high technology and high-tech products, delegate La Thanh Tan proposed to review the consistency between the name of this Article (including 2 groups of subjects "commercialization of high technology" and "commercialization of high-tech products") , but some clauses in this Article mainly refer to the group "Commercialization of high technology" (clauses 3, 4, 5) without mentioning the second subject - "commercialization of high-tech products", the delegate suggested to study and supplement for completeness.

Similarly, regarding the content stipulated in Article 19 on promoting the transfer and commercialization of strategic technology and strategic technology products, the content of the law has not mentioned strategic technology products. Delegates suggested additional research.
In Article 20, delegate La Thanh Tan proposed to add a clause regulating the relationship between the High-Tech Ecosystem and the Innovation Ecosystem (in general), and the Innovation Startup Ecosystem (in particular). Because in reality, there are many components participating in the above ecosystems that overlap and have quite similar roles, leading to the preferential and support policies for each type of Ecosystem not having clear differences in the draft Law and the new Law on Science, Technology and Innovation passed by the National Assembly at the end of the 2024 session.
Similarly, at point c, clause 2, Article 23 of the draft Law on high-tech urban areas, the phrase Innovation Ecosystem appears, not High-tech Ecosystem. Further review is recommended.

Article 21 of the draft Law stipulates high-tech incubators. According to the delegate, it is necessary to clarify the similarities or differences between high-tech incubators and innovative startup incubators (is it true that high-tech incubators are the type of innovative startup incubators in the field of high technology and strategic technology), in accordance with the definition of high-tech startups in Clause 3 of this Article.
Accordingly, the regulation states that “High-tech start-up enterprises are innovative start-ups in the fields of high technology, strategic technology, etc.” Are there any special features in the mechanisms and preferential policies supporting these two types of incubators? Delegates suggested considering adding them to the draft Law…
Delegate La Thanh Tan agreed to add regulations on high-tech urban areas in Article 23 of the draft Law, in line with the development trend and importance of this type of urban area. However, it is necessary to clarify the urban classification level for this type of urban area; clarify the management model and the level of government managing this type of urban area; can mechanisms, policies and legal frameworks be issued? (For example, point d, Clause 2, Article 23).
