Additional measures to cope with social changes brought about by artificial intelligence

Chairman of the Committee for Science, Technology and Environment Nguyen Thanh Hai said that the development of artificial intelligence (AI) will strongly affect human employment opportunities, privacy rights and many cultural and ethical values. Therefore, the draft Law on Artificial Intelligence needs to supplement regulations on principles for assessing the social impact of AI along with measures to respond to social changes brought about by AI.

Continuing the 10th Session, on November 21, under the direction of Vice Chairman of the National Assembly Le Minh Hoan, the National Assembly listened to the presentation of the Submission and Verification Report on the draft Law on Artificial Intelligence.

Regarding the necessity and purpose of the Artificial Intelligence Law project, Minister of Science and Technology Nguyen Manh Hung said that the Artificial Intelligence Law project consists of 08 Chapters with 36 articles to institutionalize the Party and State's policies, create a breakthrough legal corridor for artificial intelligence; create a favorable legal environment to promote innovation, improve national competitiveness; at the same time manage risks, protect national interests, human rights and digital sovereignty.

The Artificial Intelligence Law Project ensures the institutionalization of policies and orientations identified in documents and resolutions of the Party and State.

The Law on Artificial Intelligence is a framework law, flexible and adaptable to the development of technology. The Law systematically and comprehensively stipulates measures to balance management and promotion of research, development, deployment and application of artificial intelligence in Vietnam.

The Law on Artificial Intelligence puts people at the center with the supreme principle that artificial intelligence (AI) serves people, does not replace people, people supervise artificial intelligence in important decisions; artificial intelligence must be transparent, responsible and safe.

The Law on Artificial Intelligence manages the artificial intelligence system according to the level of risk, encourages the development of domestic artificial intelligence and autonomy in artificial intelligence, takes artificial intelligence as a driving force for rapid and sustainable growth and ensures national digital sovereignty .

According to Minister of Science and Technology Nguyen Manh Hung, the content of the Law on Artificial Intelligence inherits and abolishes the provisions on artificial intelligence in the Law on Digital Technology Industry No. 71/2025/QH15; supplementing legal "gaps" to perfect the law on artificial intelligence. Selectively refer to the law and practical experience on the development trend of artificial intelligence of a number of countries in accordance with the practical conditions of Vietnam, the law and international treaties to which Vietnam is a member.

The Law on Artificial Intelligence regulates the promotion of research, development, provision, deployment and use of artificial intelligence systems; the rights and obligations of relevant organizations and individuals; and state management of artificial intelligence activities in Vietnam. The subjects of application of the Law on Artificial Intelligence are Vietnamese agencies, organizations and individuals and foreign organizations and individuals engaged in the development, provision, deployment and use of artificial intelligence systems in Vietnam or having artificial intelligence systems that produce results used in Vietnam.

On behalf of the review body, Chairman of the Committee for Science, Technology and Environment (SCIET) Nguyen Thanh Hai said that the SCIET recognizes that management and promotion are not two opposing goals; transparent and effective management is the foundation and basis for promoting sustainable development. This is a very core issue, governing all policies in the draft Law. It is recommended to study the change of the phrase "balance" to "harmony" between management and promotion to correctly express this viewpoint.

In addition, the Law is built in the direction of a Framework Law, which is suitable for practice. However, because the AI ​​field develops very quickly, it is possible that the Law will have to be amended in a short time. Some opinions say that the AI ​​Law is the original Law and each specialized Law needs to have a separate chapter on AI.

Regarding the constitutionality, legality, consistency of the draft Law with the legal system and compatibility with international treaties,   The Committee for Science, Technology and Environment found that the contents of the draft Basic Law are appropriate and suggested continuing to review the consistency with laws such as the Civil Code, the Law on Product and Goods Quality, the Law on Technical Standards and Regulations and the relationship with specialized laws such as Information Security, Digital Transformation and Intellectual Property. At the same time, update the contents of the United Nations Convention against Cybercrime (Hanoi Convention) which was signed in Hanoi last October.

Regarding the national database of artificial intelligence systems and databases serving artificial intelligence, the Committee proposed adding core principles to ensure the quality of data serving AI such as: data must be "correct - sufficient - clean - alive" and shared in a unified manner; have a mechanism for interconnection and data sharing to prevent data from being scattered, creating bottlenecks in AI research and development; have mandatory principles on ensuring network security, data security and defense for national AI infrastructure, preventing the risk of hijacking and data leakage.

Regarding the legal responsibility of related parties, actions and errors performed by humans can also be performed by AI. Meanwhile, there are many different views on the legal responsibility of AI itself, so it is difficult to determine responsibility in the traditional sense. When an incident arises, it will cause disputes about administrative, civil, and criminal responsibility. Therefore, it is necessary to supplement principles to distinguish responsibilities between subjects and related parties, including foreign suppliers, when providing cross-border AI services and distinguish between intentional, unintentional, or errors due to technical limitations and unforeseeable;

On AI for culture, society and scientific research; ethics in AI activities,   The draft stipulates basic principles of ethics in AI activities in general, in line with international practices. However, the Committee on Science, Technology and Environment proposed adding "Accountability for ethical and social impacts in AI research and use", adding ethical responsibilities of the private sector in AI activities, to synchronize with the State sector.

Chairman of the Committee for Science, Technology and Environment Nguyen Thanh Hai also said that the Committee proposed adding a separate section on the use of AI in training, research and innovation. The draft Law does not have any regulations on this content.

However, this is an area that creates breakthroughs and outstanding values ​​that humans have not been able to reach in the traditional way, such as AI has supported protein design, discovered new materials that humans have never known, but the problem is still open such as: Copyright, research data protection, research data sharing mechanism and controlled testing mechanism (sandbox) for projects with high scientific value, exemption from responsibility for risks during the testing process when organizations and individuals have complied with regulations, etc.

In addition, the development of AI will strongly affect human employment opportunities, privacy rights and many cultural and ethical values. Therefore, it is necessary to supplement regulations on principles for assessing the social impact of AI along with measures to respond to social changes brought about by AI.

Regarding prohibited acts,   The Committee proposed to supplement regulations on prohibited acts to contribute to early identification of violations from the research stage to the deployment of AI, which must include the behavior of users, organizations and individuals taking advantage of AI to perform prohibited acts in the following direction: Prohibiting the use of AI to cause disturbances, incite politics, violate national security, manipulate votes, elections, etc.; Prohibiting the use of AI to create fake content, create images, video clips, etc. to serve fraud, insult honor, dignity, cause division and other bad purposes, etc.
