The Ministry of Agriculture and Rural Development recommends that provinces implement the decree on liquidation of planted forests, paying attention to forests damaged by storm YAGI.

The official dispatch of the Ministry of Agriculture and Rural Development sent to the People's Committees of provinces and centrally run cities stated that on October 25, 2024, the Government issued Decree No. 140/2024/ND-CP regulating the liquidation of planted forests, effective from October 25, 2024.

To properly implement the provisions of Decree No. 140/2024/ND-CP, the Ministry of Agriculture and Rural Development requests the People's Committees of provinces and centrally run cities to organize the implementation of Decree No. 140/2024/ND-CP in the province, ensuring compliance with the principles of liquidation of planted forests prescribed in Article 5 of the Decree and the implementation responsibilities of the Provincial People's Committee prescribed in Article 13 of the Decree.

The Ministry of Agriculture and Rural Development notes a number of contents that need to be implemented to ensure compliance with legal regulations and to suit the actual situation in the locality, such as: Authority to decide on liquidation of planted forests; cases eligible for liquidation; selection of liquidation form; implementation of cases of liquidation of planted forests specified in Point c, Clause 1, Article 9 and Clause 5, Article 10 of the Decree.

Report to the Provincial People's Council to prescribe the authority to decide on liquidation of planted forests under local management as prescribed in Clause 2, Article 6 of Decree No. 140/2024/ND-CP.

Direct the Department of Agriculture and Rural Development and relevant professional agencies, and the People's Committees at the district level to organize propaganda and dissemination of the contents of Decree No. 140/2024/ND-CP to organizations and forest owners in the province and city.

Organize the review and handling of cases of damage to planted forests in accordance with the provisions of Decree No. 140/2024/ND-CP and other relevant laws, including urgently reviewing, making statistics, and carrying out procedures to handle and overcome the consequences of planted forests damaged by storm No. 3 (Yagi).

In the process of implementing Decree No. 140/2024/ND-CP, if there are any problems, please promptly report to the Ministry of Agriculture and Rural Development for guidance and handling.

Previously, according to statistics from the Department of Forestry (Ministry of Agriculture and Rural Development), due to the impact of storm No. 3 - YAGI, as of September 23, 2024, a total of 13 provinces suffered forest damage with an area of 169,588 hectares (this area does not include the area of natural forest that was eroded and slid); of which the 4 most severely damaged provinces were Hai Phong City with 10,045 hectares; Lang Son with 19,729 hectares; Bac Giang with 26,415 hectares and Quang Ninh with 110,713 hectares.

At the meeting on overcoming the consequences of the forestry sector after storm No. 3 - YAGI, Deputy Minister of Agriculture and Rural Development Nguyen Quoc Tri requested that for areas of forest that were severely damaged, where the forest trees were completely broken or the remaining trees did not meet the criteria for forest establishment (the rate of falling and broken trees was over 70%), a dossier must be prepared to liquidate the forest according to regulations; all trees must be exploited and harvested. After exploitation and harvesting, the forest owner is responsible for replanting the forest in the next crop when the weather is favorable.

For lightly damaged forest areas, the remaining trees that meet the criteria for forest formation should only be harvested if they are fallen or broken. Forest sanitation and forest fire prevention.
