Ministry of Home Affairs: Retiring commune-level civil servants does not lose the village party cell secretary allowance

People who stop working as commune-level civil servants but continue to work as village or residential group party cell secretaries are still entitled to position allowances according to current regulations.

Mr. Vo Minh Thuong sent a question to the Ministry of Home Affairs , stating that before August 1, he was a commune-level civil servant concurrently holding the position of village party cell secretary. On August 1, he received a decision to resign from his job according to Decree No. 178/2024 and Decree No. 67/2025 of the Government, but still held the position of village party cell secretary.

Mr. Thuong wondered whether he would continue to receive the allowance of the position of village party cell secretary.

The Ministry of Home Affairs said that the implementation of decrees related to the arrangement of apparatus and administrative units at all levels and the implementation of two-level local government has been specified by the Government in Decree No. 178/2024 dated December 31, 2024.

This is a decree on policies and regimes for cadres, civil servants, public employees, workers and armed forces when reorganizing the apparatus in the political system.

Then, Decree No. 67/2025 dated March 15 continued to amend and supplement a number of contents to suit reality.

The Ministry of Home Affairs affirmed that in the case of Mr. Vo Minh Thuong, although he has retired from the commune-level civil service according to Decree 178/2024 and 67/2025, he is still entitled to the allowance for the position of village party cell secretary according to Decree 33/2023 of the Government.

Decree 33/2023 clearly stipulates the regime and policies for commune-level cadres, civil servants and part-time workers at the commune, village and residential group levels. Accordingly, village and residential group party cell secretaries are entitled to monthly allowances from the state budget.

Thus, Mr. Thuong and similar cases ceasing to work as commune-level civil servants under the policy of streamlining the payroll does not affect the right to receive position allowances in the village. If the competent authority still decides and assigns him to take up a position in the village, he will continue to receive allowances according to Decree 33/2023.
