Ministry of National Defense proposes to amend regulations on military service by eliminating district level

This is a new point in the draft Law on Military Service (NVQS) of the Ministry of National Defense to conform to the policy of organizing a 2-level local government model.

Accordingly, every January, the commander of the commune-level military command, the head or legal representative of the agency or organization shall report to the chairman of the commune-level People's Committee the list of male citizens who are 17 years old in the year and male citizens of military service age who have not registered for military service.

Every April, the Chairman of the Commune People's Committee issues an order calling citizens to register for military service for the first time.

Citizens must register for military service for the first time online or in person at the military service registration agency. In case of having registered for military service and changing the place of residence or place of work or study, they must register online or in person at the agency where they registered for military service to complete the procedure for transferring military service registration.

Regarding temporary military service registration, the draft states that citizens who have registered for military service, if they leave their place of residence or place of work or study for 3 months or more, must register online or in person at the place of military service registration to register for temporary military service. When returning to their place of residence or place of work or study within 10 working days, they must re-register.

Within 10 days from the date of confirmation by the competent authority, the commune-level Military Command, agency or organization with citizens must report to the Chairman of the Commune People's Committee for decision.

The draft emphasizes that the Chairman of the Provincial People's Committee decides to assign the number of citizens called up for the first time to join the army and perform the obligation to join the People's Public Security Forces to the commune-level locality; decides on the list of citizens called up for military service and perform the obligation to join the People's Public Security Forces upon the proposal of the Provincial Military Service Council.

The Chairman of the People's Committee at the commune level issues an order to call each citizen to join the army and perform the duty of joining the People's Public Security Forces. The order to join the army and perform the duty of joining the People's Public Security Forces must be delivered to the citizen 15 days before the time stated in the order.

The People's Committee at the commune level is responsible for publicizing the number, subjects, and criteria for conscription, the list of citizens eligible for conscription and performing the obligation to join the People's Public Security Forces ; the list of citizens called for conscription and performing the obligation to join the People's Public Security Forces ; the list of citizens temporarily deferred from conscription and exempted from conscription.
